  • Dooring as an offence

    Rule 239 of the Highway Code states that motorists “MUST ensure you do not hit anyone when you open your door. Check for Cyclists or other traffic.” The Highway Code serves as guidance only, and non compliance with a rule of the Highway Code is not an offence. However, s.42 of the Road Traffic Act 1988 makes it an offence to open “any door of a vehicle on a road so as to injure or endanger any person.”

    It is worth noting that it is an offence to simply endanger a person (for example if they have to swerve to avoid a crash). There does not have to be a collision. The offence is not limited to drivers, so a passenger who injures or endangers a cyclist by opening a car door also commits the offence.

    This offence is only punishable by a fine of up to £1,000 and no penalty points can be imposed on the offender’s licence. It is dealt with by the magistrate’s court and the defendant can plead guilty by letter. This is clearly wholly inadequate given the number of cyclists harmed by this, and the potential for harm it causes. Opening vehicle doors into the path of cyclists can often lead to serious injury or even death.

  • I have been to the police and given a statement, gave the details of the two witnesses and showed the officer the pictures and short video of the car/driver.

    Now they have to make contact with the driver to confirm who was driving the car the time. The description I gave matched that of the registered keeper.

    They are going to attempt to prosectute for driving without due care and attention, and possibly reckless driving as the driver crossed the centre line of the road.

    The driver purposely bumped my back wheel twice and the second time driving over my bike. So it seems abit more than 'driving without due care or attention'. The driver 100% knew what he was doing.

  • omw home I was going east on Whitechapel road on the cycle superhighway, at the start of brick lane a car is turning right from Whitechapel road towards brick lane, the car is just outside of the cycle lane and stopped, the car edges forwards a little but seems stopped so I carry on as I believe (this is the bit I'm questioning) it is my right of way, the car drives into the side of me knocking me off (hit my leg and sort whipped the rear end out), and the car then speeds off up Brick lane.

    Obviously the hit and run is not okay, but what I am questioning is whether it was in fact my right of way when I kept going? If anyone understands what I mean from this and can tell me I would be grateful.
    (I'm okay and bike seems okay, bit roadrashy and a white t-shirt is all bloody but hey)

  • Glad you're ok, but if in any doubt at all, do get yourself checked out. Unless I am misunderstanding, you would have had priority as a vehicle wanting to make that manoeuvre - crossing the other section of the carriageway - would have had to wait for it to become clear before doing so.
    The Highway Code states re right turns:
    Rule 180

    Wait until there is a safe gap between you and any oncoming vehicle. Watch out for cyclists, motorcyclists, pedestrians and other road users. Check your mirrors and blind spot again to make sure you are not being overtaken, then make the turn. Do not cut the corner. Take great care when turning into a main road; you will need to watch for traffic in both directions and wait for a safe gap.

    No, there's no 'right of way' in this and most other circumstances. It's quite a misleading concept:

    As the Highway Code stresses at the beginning, only rules that contain MUST and MUST NOT are legal requirements. Anything else is just advice (some of it to cyclists is of questionable quality).

You may be fined, given penalty points on your licence or be disqualified from driving. In the most serious cases you may be sent to prison.     Quite apart from whatever legislation might exist or be enacted in the future, if you're behind another vehicle that appears to be turning across you, just hold back. From what you say it seems that the driver saw you, checked him- or herself for a moment, and then made the same assumption as you, that they could go because you would not proceed. It would obviously have been more prudent on their part to wait, too, and it's entirely inexcusable that they then left the scene, but it's wiser not to take a chance like that without some clear communication between you.

  • About to make my first ever report to roadsafe for whatever it is worth. Had a mini cab try to bully me off the road on Portland Place.

    I was pulling away from the lights heading towards Park Crescent when the car behind starts hooting and revving, I look back and he's so close he's virtually touching my back wheel. There are cars parked on the left so I've nowhere to escape to and he just accelerates past with a few inches to spare.

    Inevitably he is sat at the next set of lights at the Marylebone Rd junction so I pull along side to have a word. Either he doesn't notice me next to him or he is ignoring me so I tap on his window, he rolls it down and immediately launches into a "don't touch my car" routine and follows on with the "you shouldn't be in the middle of the road" schtick. I suggest that as he does it for a living he should perhaps "fucking learn to drive" sometime, which prompts him to make a vague "if I didn't have clients in the car..." threat. And he was right, he did have "clients" in the car, in fact there were two sharing the other front seat. I put an end to our discussion as the rage is threatening to take over and he's a big fucker so I would be no match if I did decide to do something silly.

    When the lights go green I realise he is also heading into the park and, as I don't fancy having him try to overtake as I'm going through the gate, I slow up to let him pass. Silly fucker still does the brake and swerve at me as he passes.

    Got the reg and a description but there was no contact, and probably not enough verbals to constitute proper threatening behavior, so Roadsafe and hope he gets caught for something before he does some actual damage to someone.

  • I probably wouldn't have thought of it at the time either, but could've suggested to his clients that his services perhaps weren't worth paying for and that as they departed the vehicle they would also be in a perfect position to note the minicab license number and car reg for reporting to roadsafe & TfL.

  • Was just in the cycle lane coming into Stockwell from Vauxhall and an ambulance next to me just started veering into the cycle lane, cutting me up. If I hadn't have slowed and she would have squashed me into the curb. got to the next junction and tapped the window to tell her what she'd done and to be more wary and saw that she was on her phone! I got a bit too angry and didn't have the inmediate foresight to snap a reg, but I tried later but it's blurred. Point is; is it worth reporting if I've only got the last 3 letters of the reg?
