    Can you argue that you touched the wing mirror to indicate to the driver that it would have hit you, or even that (if the wing mirror had an indicator in) you were trying to draw his attention to it to make him understand that he didn't indicate?

  • Whilst James may have a history of conflict on the highway, i think in this case its pretty clear cut that the driver was/is a dangerous cunt, and should be prosecuted - what happens if the next time this happens he kills someone?

    i don't think we should let them get away with any bad behaviour and involve the law in every instance (asI did when i was assaulted in July and am awaiting confirmation by the CPS that they'll accept the police's claim of ABH))

  • James, I'm sorry to hear about this and would like to add a little perspective. There are some very valid points being tossed around and no doubt you probably regret tapping / hitting his wing-mirror and calling him a cunt. I doubt you expected him to punch you.

    However, in balance he escalated your escalation. Despite the legal complexities I'd find it incredibly hard to believe that any court would find being called a rude word and having your wing-mirror tapped but not damaged (as per witness statement) acceptable reason for punching someone. I'd also frankly be amazed if a claim were put in against you by the driver, who in all likelihood knows he went too far and is currently worried about repercussions. He'd probably rather it 'all went away' as quickly as possible.

    I'd say have the courage of your convictions and press charges, even with 80 to 85% you're in a very, very, strong position. Nothing in life is ever a dead cert. And if you don't do anything he will have got away with completely unacceptable behaviour, that was antagonised by you and your actions, safe in the knowledge that he can probably get away with such actions in the future. You see in some ways you almost have a responsibility to take it further.

    Perhaps this incident could be a turning point for you. Fight this one last fight, in all likelihood win and let some thug know that punching people (even if they're rude or touch your precious vehicle) is not acceptable. And try not to be quite so naive in future when it comes to such altercations even if the adrenalin is flowing, know that getting punched, kicked to the ground, or God forbid stabbed is hardly worth being 'in the right'.

    Apologies if I sound like your dad but look at the above objectively.

    cunts exist in cars and on bikes. just 'cause someone rides, doesn't necessarily mean they're automatically on 'our side', nor does it mean we cyclists are never at fault/blameless, especially not ones who seem to get in to problems every week, when no-one else seems to.

  • I used to get into constant shit almost on a weekly basis. I think I must have attracted it as it happened so often. I must have chilled out now and changed my approach to cycling, or maybe I am just a happier person. Who knows, who cares. But I very rarely get into scrapes on the road anymore. Only this week a van decided to cut right accross my path from being stationary in the right hand lane, deciding to take a side road whilst I was coming down the bus lane. I anticipated it, of course, but still smashed straight into the van side on. I called him a fucking cunt and carried on cycling with a bashed hip. I couldnt even be bothered to stop. He held his hand up to apologize, clearly indicating regret and acknowledging he was wrong.
    This time a year or so a go I would have jumped off my bike and gone mental.

    I think my changed attitude has helped me avoid shit like this

  • ive started to calm down a bit after an incident where a driver was massivley wrong and he didnt appreciate being told so by a 15 year old kid. he got out the car faced me off and only decided not to beat the shit out of me when he realised we were outside a primary school at home time and there about 30 worried people watching. you never realise who is in the car, i had told this man that it would be very stupid to touch me because he would obviously be assaulting a minor, he told me he had been to prison many a time and would happily go back for smashing my skull in.
    no minor status for me either now :)

    james, ffs, do try and calm down a bit on the road out there. i just cannot accept the roads/drivers in west london are any more fraught with danger than the ones many of us deal with east, south, north or central.

  • I said nothing of the sort. It is an offence straight off, and can also be an assault; it depends on the circumstances. At no stage did I say that was reasonable self-defence; I specifically said I didn't know what happened, and that in any event the violence was not justified. However, I haven't seen many road rage incidents when people use the term "fuck you" in a cool, calm and non-threatening manner. I note in passing also, that exactly as predicted, the story has developed as it goes along.

    Try to be objective, rather than jumping to conclusions that fit your own bias, is a good rule when considering legal process, rather than just wading in with a load of self-rightous indignation expecting the world to share your view without question.
