  • Whether or not your witnesses want him prosecuted has no bearing on whether the police/CPS will deem it a worth their while to pursue criminal proceedings.

    Plus, lets put this into some perspective. A huge body builder type driving a 2 year old range rover that punches people doesn't conjure up an image of a particularly nice piece of work. You might be opening yourself to a whole lost of unpleasantness if the police do take things further.

    In hindsight, you have been better off letting saying nothing at the time, making note of his registration and resorting to more clandestine methods. E.g. quick call to 999 to say you saw a black range rover being driven erratically and nearly hit some school children followed by a stream of calls to crimestoppers, etc... with some incriminating info.

    I hope everything turns out OK for you.

    I ride daily and can guarantee that if I am on my bike for more than an hour or two,...that I will encounter a situation where someone will either cut me up really badly or some other major infringement of my space that would result in injury unless I take evasive action...Yes...an us and them mentality does no favours, but then neither does shifting blame because you have a problem with the person in question.

    You may have an axe to grind with James...and as I don't know either of you it makes little difference...

    However...placing the onus of blame on him....when its pretty fucking obvious that its almost always the vehichle drivers fault...and generally speaking...it is...almost always there fault...they are mostly fucking hopeless...and yes..I do know cyclists that make me hold my head in my hands as to how shockingly bad she is...though the majority of the people in this forum have a good deal of road knowledge and savvy..

    so...whinging on about it being james...is fucking pathetic...and makes you look like a grade A twat...or something else that is rubbish..

    Had to say that...I get into a lot of scrapes...thats not my fault...I could be more forgiving...though to be honest...if they have just been bloody ignorant and cut you up ...why should I say ...oh...its ok? if it's an old lady/mother with children I do...(they usually say sorry ) if it's anyone else...I shout...loudly...

    No, LPG speak sense (well sometime).

    it's entirely plausible not to get hassle/cut up/etc. during heavy traffic and especially daily, I can related to that.

    It's really down to how you work with the traffic, how to expected the unexpected, how to be assertive etc. by having a good road position, looking back more often (looking at the car behind you while waiting in traffic for example), resisting the urge to get right in the front of the ASL like everyone else and wait in line with other motorists (like 2 or 3 cars away from the light), etc.

    James got a smack not because he was riding correctly, in the correct lane and able to expected the unexpected, but because he didn't let it go and ride away.

    It's rather similar to talking with your mouth full of food- you can be understood, but it's harder work for the person trying to listen to you, and it speaks of a certain disregard for the comfort of others.

    If people drive badly, risk lives, put others in danger, the fact should be brought to them in any way possible. If some fucker is so arrogant as to almost kill someone, and then punch that person in the stomach for having the audacity to complain, then that driver deserves a whole world of hurt.

    Being passive is sometimes the answer but not always the answer. We should stand up for ourselves, even if by doing so we put ourselves in further danger. I am not advocating violence, only powerful verbal protest and self defense. If we do not complain, if we do not stand up for The Cyclist, then those cyclists with less confidence will get trampled on too, and perhaps chuck their bikes in a skip, buy a car, and never let there kids out on two wheels because 'it's too dangerous out there'.

    He was in the wrong twice - once to make the turn without indicating across your path, once by hitting you. You did no damage to his vehicle, swore in a context which I think most impartial observers would agree was a reasonable one to swear in, and in no way initiated the violence in the situation.
    For me, it would just come down to whether I could face the investment of time and emotional energy to get through the process.

  • I went bananas at a coach driver who cut up then tailed, then actually bumped my wife whilst riding a few months ago. I had to drop it under the threat of prosecution by the dickhead.

    However, the point of this was that the Police officer who dealt with us said that if it had been me who had been the victim of the driver then my swearing etc at him would not have been considered a disproportionate reaction and wouldn't have been held against me. IANAL etc

    Because in our legal system, the testimony of someone who works within that system is taken very seriously indeed. If you've got a witness who is a prison officer, a magistrate, a police officer etc then their testimony in court will carry a lot more weight than the testimony of, say, a Big Issue seller.
