• Cheers tommy

• Scooting counts as riding - it's from the same case law that defines someone pushing a bicycle as being a pedestrian.

Absolutely right, scooting is using the mechanisms of the bicycle to propel yourself.

• What excuse for stop and search could they give?

If you are in Greater London or any of the other section 44 designated areas they do not need a reason. The police can search anyone they want for no reason.

• What excuse for stop and search could they give?

I believe they can call in a 6-44: Officer Bored or an 8-72: Officer in need of a powertrip. Just hope it isn't a 10-13: Trumped up charges.

• Ok

will try to behave

the reason for the fine being cancelled was they used he wrong offence code on my penalty notice.

• From a gov.uk site somewhere:

"A fixed penalty is not a fine. Payment of the penalty by the recipient discharges there liability to conviction for the offence for which the FPN was issued. It does not constitute an admission of guilt, but removes the possibility of the creation of a record of criminal conviction."

• From a gov.uk site somewhere:

"A fixed penalty is not a fine. Payment of the penalty by the recipient discharges **there **liability to conviction for the offence for which the FPN was issued. It does not constitute an admission of guilt, but removes the possibility of the creation of a record of criminal conviction."

What, this sort of spelling is allowed to exist on a .gov.uk site?

• On a similar note i had a lovely result today:
Westminster decided to change their mind about the parking ticket i was contesting today......

They must have decided that my wife parking because she had to puke with morning sickness and me jumping out of the car to buy her a bottle of water while on yellow line was too cunty even for them..........

i was really looking forwards to my latest adjuciation too, dammit, my righteous fury and incandescent rage was already building to new heights.....

who the hell do i take it out on now?

Don't fall for the piffle that you have to carry a bicycle when on a footway or pedestrian crossing. Anyone pushing a bicycle is a "foot-passenger" (Crank v Brooks [1980] RTR 441*) and is not "riding" it (Selby). In his judgment in the Court of Appeal in Crank v Brooks, Waller LJ said: "In my judgment a person who is walking across a pedestrian crossing pushing a bicycle, having started on the pavement on one side on her feet and not on the bicycle, and going across pushing the bicycle with both feet on the ground so to speak is clearly a 'foot passenger'. If for example she had been using it as a scooter by having one foot on the pedal and pushing herself along, she would not have been a 'foot passenger'. But the fact that she had the bicycle in her hand and was walking does not create any difference from a case where she is walking without a bicycle in her hand."
