That said, we used to get some really surprising ones at my last job (I was a member of the patent board).

What are the chances a law suit like that is gonna take? Most of that stuff seems to be user interface stuff... Did Apple take Microsoft to court for patent infringement when WIndows came out?

Since Apple stole all the GUI shit from Xerox, i doubt it.
Basically, even if they have to remove multitouch, it's still supported by the hardware so hackers will produce custom roms to support it and bob's your uncle.
Fuck Apple.

Since Apple stole all the GUI shit from Xerox, i doubt it.
I was always under the impression that Jobs and Larkin were at PARC and they qwere allowed to walk out with the tech when they left? Oh well... I love Mac OS but I agree with the Fuck Apple sentiment... They've become the enemy... It's a natural progression, I guess... :/

And they lost. Because you can't patent look 'n' feel and you cannot copyright it either (you can trademark it, but then take a look at homebrand washing up liquids vs fairy... you only have to be arguably different).
Everyone who has commented on this case wants Apple to lose.
Me, I was unsure, still swinging between a blackberry or android for my next phone, but this lawsuit says to me that the android must be awesome.
Patents are defensive weaponry, you attack by out-innovating and executing better. You use patents (which are slow as hell) to defend. That screams "If you can't beat them, sue them"... which also screams, "Nexus One has leap-frogged the iPhone".
So now I'm 100% on what my next phone is.

... this is a war that Apple should be proud to win in the market, not in a courtroom.
Apple should continue to grow its position in the smartphone business by being better than its competitors, out-innovating them, out-designing them, out-pricing them, out-marketing them, and out-selling them, using patents as defensive protection.
Instead, it's going on the offense with patents, not just products, which reeks of fear. As Apple blogger John Gruber reiterated yesterday on his site Daring Fireball, "If you can't beat 'em, sue 'em." He added, "I feel this suit against HTC is a terrible mistake."

Than what, the iPhone OS? Maybe, but it's still a modifed Linux kernel with proprietary software on top. It's multi-tasking sucks too.
The point is that Apple were cool until they went down the 'attack your competitors with patent suits' route. Google are cool today, but they'll do something, and it'll probably be sooner rather than later, that reveals their true hand, i.e. the 'do no evil' schtick is bullshit.
