  • It's not Amazon and so far as I can tell distance selling states that return postage is the responsibility of the buyer if you change your mind outside of the cooling off period which is fine. My main question is about the restocking fee (albeit we don't know how much this will be).

    sorry I wasn't being all that clear, my vaguely alluded to point was if you could come up with a reason why upon receiving it you found that it was unsuitable for its intended task based on how they'd sold it online then they would be liable for the return postage and any restocking fees not you and i'm sure the cooling off period is longer than 7 days if bought online.

  • My mate has a font we'd like to use for address stickers. Can i email him the addresses, he can put them in a word doc in the font I want, then he emails it back to me to print onto labels in Word using mail merge? Or will my Word not recognise the font and everything go to pot when i try to open the doc?

    If not obvious - i have no design skills.

    You can just drag and drop a .ttf file into the fonts directory and it asks whether you want to install the font.

  • I "gave" my dad tickets to see Coriolanus for xmas. When I checked before xmas there was loads of availability. Now it's sold out.

    I'm trying to find another Shakespeare play to take him to, but I'm not having any luck.

    Any suggestions? Any other ways to get tickets - that Monday 10am discount thing has passed I think.

    I'm not sure you have any legal rights once the provisions of DSRs are out ie after 7 days, if the goods are fit for purpose.
    The situation will be governed by the contract you made w the seller which will essentially equate to the t&cs of their website at the time, assuming they had one of the tick boxes where you agree you've read them.

    if <7d return postage is the sellers responsibility regardless of the reason for return but this is often flouted

    Does it have to be right now? The Globe is always good, but they only put things on during the (supposedly) warmer bit of the year. If you don't mind standing up and taking a gamble with the weather, you can get tickets for a fiver.

    That was my next thought, but as you said stuff won't be on yet.

    Ideally it would have been in late Jan. I'm pretty gutted I didn't just ask him for his availability before xmas. It's also a shit time of year, because so many things seem to be finishing/sold out.

    This is exactly the reason my dad is baffled by modern computers; he was a systems analyst/programmer in the days when you looked after every bit on your own, or it went wrong. Now there are always at least 3 different ways to do anything on a modern desktop OS.

  • My girlfriend bought some home brewing equipment online for her dad for christmas. Turns out he has it all already so she wants to return it. The shop are stating that she can return at her cost for a refund minus a restocking fee. Do the DST allow for this? She's outside her 7 day cooling off period.

    Provided you give your customer the required written information no later than the time the goods are delivered, their cancellation rights end seven working days after the day on which they received the goods.

    The date of notice is generally the day you initiated it, i.e. date of postage of written notice, date an email was sent. Notice by phone only valid if permitted by the contract terms.

    Return and collection of goods

    Under the DSRs, when a customer cancels a contract but has already received the goods, they are under a duty to take reasonable care of the goods and to return them to you. However, this only means that they have to make them available for collection by you from their premises, following a request from you in writing or on a durable medium available and accessible to the customer.

    If you want your customers to return the goods to you and to pay for returns when they cancel a contract under the DSRs, you must include this in your terms and conditions. This information must also be given to the customer as written information (see The information you must provide once the customer has decided to buy under the DSRs).

    The purpose of the DSRs is to allow customers to examine goods they have ordered as they would in a shop. If that requires opening the packaging and trying out the goods, then they have not breached their duty to take reasonable care of the goods.

    In these circumstances, you cannot insist that customers return the goods as new or in their original packaging. You may ask customers to take care when they open the package or return goods with the original packaging, but you cannot insist on this.

    The DSRs do not provide for goods to be returned in a fit state for resale.

    Period for cancelling the contract is 7 working days from delivery, not including weekends or bank holidays.
    Notice by email allowed.
    Seller is responsible for organisation and cost of retrieval. Cannot insist on undamaged original packaging.
    Refund should total 100% of sale price and delivery/packaging fees except giftwrapping, express delivery

  • Since these items are merely unwanted (unless I'm mistaken) after 7d from receipt they can charge any restocking, postage, etc etc they see fit since they are under no obligation to take the goods at all.

    obviously the terms of the actual contract may specify different but we don't know about that

    re my comment on postage, I know the law but it's routinely ignored. eBay notoriously makes you send back defective goods at cost let alone dsr cancellations

    I've applied thornproof dressing to my Super C panniers with great success, but will I have similar success applying it to a cotton canvas bag?
