    In case the earlier message was confusing (about the 10" length and 6" wide) it seems the seller got confused when I asked him to measure the 'seat tube', and sent him this diagram to show how to measure it:

    It appears he measured the saddle itself. So if you're looking for a 10" saddle, then he's your guy!

  • How do I best approach the issue of getting compensation for an item that was mis sold? Shall I ask outright or allude to it and hope they do the right thing?

    I'm happy to keep it as I can work around/repair the issues and as it came from America and I ended up paying duty on it I really don't want to have to send it back.

  • ^ unfortunately, i think that unless you're willing to send it back, you're unlikely to get any kind of compensation for it being mis-sold.

    Also, don't expect anyone who mis-sells something to "do the right thing" as they are bound to be a knob.

    He's got me trapped though, at best I'll be £60 down because of the import duty which it seems he has no duty to refund(?). I can't face sending it back because the prick will just resell it and I'll be the only who has suffered.

    Shall I just neg?

    I just tried to place a bid, that got rejected as the item does not ship to the UK, so I then tried to message the seller.

  • All the time. Norway is often not listed, even when EU countries are. A quick question usually sorts this. Recently I've been blocked from even asking questions.

  • I bought a couple of these for the tellies in the house. When they arrived they were smaller than described (36x18x10 not 36x19x11) and there is a rip in one of them:

    We have checked our recent stock of this item and looks like there is a bit of a problem with the sizing this time and we are looking into it. In the mean while, we can not have them exchanged, as that is the only size we have available at this time. Saying this, due to the problem at our end, we can issue a 25% refund as a goodwill gesture from our company, with you still keeping the goods OR we can have them all collected back and issue a full refund upon receipt.

    Please do let us know, whichever solution you prefer and we will do the same.

  • I've just bought some items on ebay from a seller who said they didn't accept returns, however they failed to mention that some of the items were damaged and/or very poorly repaired, they only put that some parts were "used please note they are ok but you prob want to replace".

    What do people reckon my chances are of getting help from ebay/paypal with returning for a refund? I'm trying to decide wether to go along the "goods not as described" line or wether to ask for them to collect and refund as I have changed my mind within the cooling off period as mentioned in the distance selling regulations.

  • If it's 'damaged' then it's not 'ok', there's a difference between selling usable but repaired items and things that are just fucked.

  • I think it may be a matter of opinion, as the seller obviously thinks some of the items are useable but I wouldn't be able to use them in the condition they are in. I basically think that if you are selling radio controlled car gear that has a bent chassis and all the bodyshells are patched up inside with car filler and strips of metal (which would make them illegal for racing at a club) then you should mention this on the auction page.

    I'm also clutching at straws but I didn't notice the bit he put saying "No Barrety" and was disappointed to find that the BATTERY in the photos wasn't included.

    I'll e-mail them, I'll be pleasantly surprised if the reply is not written in the style of an illiterate muppet.

  • Tell Ebay that the package was full of Barrety despite the seller's assurance to the contrary.

    Instant refund, job done.

    both being sold by the same person (same photo location), and the person ONLY sells bikes. Stolen? Strikes me as being dodgy as hell.

  • I'm dragging this thread from the recesses of history rather than starting a new one.

    I won, and subsequently paid for, an auction for some Mavic shoes. The listing stated free postage however the seller has now contacted me stating ebay automatically relisted the item after a previous auction where the winner didn't pay. They are saying that the listing price was incorrect (should be £50 and not £40 as on the auction I won) and that the postage should be £11 and not free. They are asking me to pay the extra £11 or mutually retract from the auction.

    Where do I stand on this? I don't want to retract and I don't want to pay the extra £11. I want the shoes for the £40 I've paid. Unfortunately I don't think the seller's obliged to send the shoes as if I don't agree to pay the extra they'll just make up some excuse about losing the shoes and no longer being able to sell them.

    If it comes to it I'll pay half the postage as £40 is a decent price but I'm loath to spend £11 as a) the listing stated it was free and b) £11 is a rip off!

    Any advice as to where I stand on this? I've contacted ebay but if past correspondence are anything to go by they won't give a shit!

  • I've already paid. I had a similar with a different item, although I hadn't paid and ebay favoured the seller and cancelled the sale. I have a feeling this will be the case this time. I'll wait and see what ebay say...
