Ooof, sorry to hear that. Definitely needs to be reported she caused the accident as surely as if she had made contact with you.
Heal up fast.

Sorry to hear that, Clara! Good luck with pursuing the case and best wishes for your recovery. What's the exact nature of the fracture?
-
• #1979
Report her, make a civil claim. Push for a crime reference number if you can, as that would probably lend more weight to any claim.
And heal up soon.

Some bone at the back of my elbow with a funny name. Apparently it's the 'best' one to break. Stopping me from straightening or putting any pressure on my arm and fucking painful even with all the painkillers they've given me!
I tried to fill in an online form to report it but that told me to call 101 which i did, the police man told me I didn't need to report it! But if I really wanted to I could go into the police station and do it there! Less than helpful as i'm currently slumped on the sofa in alot of pain. -

I spent quite a while on the phone to plod the other day, they were vehement that with no injury sustained I might as well right up the report of the incident and then use said report to line the cats litter tray.
I find this annoying.

The radius?

Sounds about right, apparently I should only report it if the car driver was inured as well! yeesh!
-
• #1984
That's simply not true. I honestly think that you take pot luck calling 101 between getting a total knuckle dragger with an attitude problem or a simpleton with no significant experience, knowledge or responsibility.
-
• #1985
Is there anywhere else online I can report it?

What the fuck? How does that fucking work? Are you meant to launch yourself over the bonnet, through the screen and headbut the driver?
And what difference does it make if the person causing the damage gets injured? If I was to get stabbed could I only report it if the bloke that stabs me cuts himself while doing it?
Sounds like a stupid "say anything to get rid of her so I can go back to eating my doughnuts" move, don't believe a word of it.

I posted the links to the forms taht you will be given somewhere, I'll dig them out...
Edit - all forms here:

Clara, get yourself to some legal advice, pronto.
Your lack of witness statements might not work in your favour, but you need to get proper advice as soon as you can. The forum has a list, LCC have a list, CTC will have a list, etc..
-
• #1989
Oh dear, get well soon and get in touch with a lawyer like others have suggested. Take pics of any visible injuries and make notes of pains and recovery etc.

Heal up fast Clara,
Sue her. silly funt. Use a proper lawyer, not a firm of ambulance chasers.
In situations like these it's probably best to hit the car.
Then they have no leg to stand on as they have hit you, but also car bonnets have a lot more give and may give you a softer landing than tarmac.I got away with a car turning into me and me landing on his bonnet with just a scratch and some bent forks once. To be fair missing the guy then wasn't an option - he just drove straight into me, but I had just enough time to get my legs the fuck away from his bumper and land on his bonnet.

You're an LCC member, aren't you, Clara? Give Levenes a call and get free legal advice.

Clara - if you have the vehicle registration details, go to www dot mib dot org dot uk where for £4 you can find out who insures the vehicle, and therefore consider taking out a claim against the insurance company for loss of earnings for your 4-6 weeks off work.

I can't believe that they got it so wrong. You and the car driver have a duty to report the injury as soon as possible. Even if you crash on the road with no other vehicle involved any injury should be reported. I will complain about bad advice on the 101 line to the police we work with on the Cycle Safety Working Group. -

Thankyou so much. The guy I spoke to even went off the phone to check and then came back to me with that! So disappointed that they just didn't seem to care!

Heal up fast m'dear.
Popo on 101 sound like they need some serious retraining to remedy this.
Hopefully if you just keep on at them eventually they'll put you onto an officer who does care.
Well done for your ninja reflexes hopefully avoid a much worse incident.
Did you make your flight in the end?
Hope the legal tings proceed as they should. -

Hi Clara, i call the 'non emergency line' often or used to as we had alot of local trouble where i live, they are there for you to log any incident, if it is bad enough to concern you, if you are injured even more so, i would call them back and try again and if no joy ask to speak to a suppervisor, they need to log it if you want it logged.

There were police and an ambulance on Lower Richmond Road just after Putney Bridge. There was a blue, steel road bike leant up against the railings. Rider was presumably inside the ambulance. A car was stopped and its two occupants were being interviewed. I heard one of them say 'but he was shouting his mouth off'. Seemed like fine, upstanding types. Couldn't possibly imagine them being aggressive and thuggish towards other road users in the slightest.
Hope the rider is OK. That junction over Putney Bridge is bad, with noticeable aggressive driving.

Hi All,
I don't really want to put too much detail on here but towards the end of the month a driver who assaulted me is appearing in a magistrates court and being charged with dangerous driving and assault causing actual bodily harm (which he did using his car). The incident was in May and is has taken this long to get him to court so that he can plead guilty or not guilty. If he pleads guilty then he will get sentenced accordingly, if he pleads not guilty the case will go to a crown court and I will need to attend, although only as a witness. I was told by the police that I would not need a lawyer so I have not looked for one. Looking at some of the posts in this thread it seems that people get legal advice straight away. Am I wrong for not getting legal advice? Should I do this now, or wait until he has made his plea leter this month? And if he is guilty (either pleads guilty or gets found guilty at crown court) then how will I go about claiming for damages (2 broken bones, one of which has not healed and will need surgery).
Thanks in advance.

I can't see how legal advice can do harm. You seem to have quite a few questions about how it will continue. There's a good deal of advice scattered throughout the forum but it's probably hard to find, so picking a lawyer's brain and playing through the scenarios may well be worth your while, especially as they can probably advise you whether they can work on a 'no win, no fee' basis.

In this case it would be him versus the Crown, right? It's not a civil case? Remember, I'm not a lawyer, have no idea what I'm talking about, accept no liability etc...
Book her Clara.
