    I've got nothing really to claim this time though (other than adding to my ever-increasing bike anxiety and scaring the shit out of my colleague), so I probably won't pursue them more than sending them a series of increasingly whiny emails.

  • I'm lucky living out in the sticks and having ridden into London from High Barnet earlier this year it definitely reminded me of what I wasn't missing..lol
    However there are plenty of semen guzzlers this way too.
    In fact I'm seriously considering using the power of arrest the next time any driver assaults me with his/her vehicle and/or themselves.

    As per the law which says:

    "A breach of the peace is not in itself a criminal offence, but a police officer or any other person have a power of arrest where there are reasonable grounds for believing a breach of the peace is taking place or is imminent. For a breach of the peace to occour, there must be an act done or threatened which harms a person, or his property in his presence, or which puts a person in fear of such harm. Something which merely distresses or offends someone will not normally amount to a breach of the peace"

    Last time I stopped a bus for 10 minutes to explain to the twat behind the wheel that he'd tailgated/harassed me when physically not able to overtake, then forced an undertaking maneouvre to the stop not 50 metres from the top of my street.
    he told me he was calling the police, I said go ahead as I could then show the plod his on board video and the traffic laws he had just broken never mind his attempted assault.
    Gave me some bollocks about having being a driver in London which made me chortle...
    so next time I'll be going for the power of arrest line..wish me luck :o)

    I would love to know what happens if you attempt to citizen arrest a bus driver. I can't see that going badly at all.

    Obviously depending on the level of offence/threat will ultimately decide what action I take, if the police can get there then it wont be needed.
    Common assault is defined thus:

    Common assault is committed when one person causes another to apprehend or fear that force is about to be used to cause some degree of personal contact and possible injury.
    Just because that force is from a vehicle (even more potential damage/injury in fact) makes no difference.
    A citizen's arrest or power of arrest can be justified if the assailent is clearly threatening or has actioned the assault.

I suggested he would have a look at the Highway Code; his answer was that he doesn't know what the Highway Code is. There was a witness who intervened as the driver continued to shout his threats. The driver then proceeded to rip off his own number plate (???), threatening to burn the house of the witness when she and her kids are sleeping. And so on and so forth.

    Needless to say, I am going to report this to the police.

    Threatening behaviour is also a crime. Let's hope she also reports him.

  • Yes, she has already done that. We obviously exchanged our contact details. I reported the incident through RoadSafe but I now realize I also need to contact the police by phone. To be honest, the whole affair has left me quite shocked.

  • At that point he must have known we already had his number. The witness sat in her car writing down what he was shouting. I think his original intention was to throw the witness with the plate (he first raised plate as if to throw it at her). He then changed his mind and threw the plate inside his own car. He also said the car he was driving wasn't registered in his name. While he sped away he continued to threaten the witness, saying he will track her down using her register number.

  • Ok - little advice please if you can be bothered to read the following story.......I was cycling home today as normal about 7pm ish. nice evening and So heading down past Lambeth North towards Oval. We all stop at the lights by the Imp. War Museum and when they turn green set off. The cyclists are in the left lane all going straight on and in front of me is someone who can be described as "portly" on a bike in the middle/right hand side of the left lane. A blue fiesta drives past, beeps and "Portly" gives the bird. This then results in the brakes being aapplied IN FULL by Fiesta man, locking up and he then pulls over to the side of the road and gets out shouting. I stop, take a picture of what is going in (should have recorded) and after a bit of effing and blindiing Fiesta man gets in the car and drives off. I turn round to see if Portly is ok and it turns out they had done a runner as they were scared. A lady from the bus stop was/is a cyclist and spoke to me and asked if I needed a witness - as nothing had happened apart from some shouting I said no.

    Is it worth doing anything about it, no injury, no serious threat and just a scaredy cat fat guy and an angry fiesta driver

  • I once was "bumped" very lightly by a car from behind because according to the driver I was going too slow, I wasn't even in the middle of the lane nor was I going too slow. Anyway fast forward to end result, I reported him and he had to go to court and fined £450 plus 6 points off his license for failing to stop (he did but only to swear at me) and provide driver's details. A police friend of mine said it was classed as a "hit and run", I didn't fall off my bike nor was I injured.

    From what you have described here, it does look somewhat similar to my experience - a driver provoked a cyclist and endanger other road users by acting inappropriately. Did her go in front of the cyclist before slamming the brake? Coz if he did then it's pretty obvious then you have a case, methinks.

    I would report him and it's best to do it within 24 hours.

    You'd need to actually come in contact with the offender in order for it to be so.

  • Listened to the above and logged the details - simples. Cheers for the advice. HAve the guys registration but shame didn't get witness details
