oh for sure. having thought about it, it's the whole process that worries me to be honest rather then encountering them again. i felt much more threatened by their actions behind the wheel rather than when they were out of the car making verbal threats, if that makes sense. hopefully they'll do the sensible thing, plead guilty, and i won't be needed.

Was this all based on video evidence from you?
-
• #8504
yep

So presumably they've used up their one 'get out of jail free card' driver awareness course. Time for an actual conviction.
I know it seems stressful/worrying but you're doing the right thing. -

thank you.
i need to email them back with any important dates that mean i cannot attend court over the next 6 months, i'll ask if they can give me any more info on what has happened so far.

You may not even end up in the witness box. I got mugged a few years ago and went to court.
As soon as I turned up the plea turned to guilty and I wasn't called. I guess the offender's legal representation was banking on me not being present as I'd moved from Brighton to Leeds in the meantime.

Has anyone roadsafed someone for stopping in an ASL? Or attempted?
Full infraction of pulling up and stopping in the ASL when the lights are red. -
• #8509
Done it once or twice. In my experience it has to be very clear ie. your footage shows the lights changing to red and in spite of having plenty of time to slow down and stop behind the line the vehicle pulling up across the ASL anyway. If the footage shows you filtering through stationery traffic and arriving at an ASL full of scooters etc with no context illustrating how they ended up within the ASL it's likely they will dismiss it due to 'lack of evidence'.

interesting point and I'm sorry to hear you that were mugged! i got an email back from the police after I asked how it came to this:
Just to explain why this case has reached court stages. it is because the driver was ineligible to do a course and then failed to fully comply with the Conditional Offer of Fixed Penalty by paying the fine and surrendering the licence, no licence was received to have the points endorsed. Therefore, due to the Conditional Offer of Fixed Penalty not being fully complied with, the last option we have is to send the file to court.
they seem like a bit of a daftpot to me so makes me wonder if they'd have the sense to make a guilty plea. time will tell! in the meantime i'll have my wedding / funeral / potential court suit dry cleaned... just in case.

Sounds like they are either burying their head in the sand or any more points will be a loss of licence.
Seems possible they won't even turn up to court.
Stick with it, Dude. -
• #8512
Are you aware of what the outcome was? Fixed penalty?
-
• #8513
i got a confirmation saying they'd been issued with a notice of intended prosecution but little else to say specifically what that entailed.... looks like it's either a fixed penalty and three points:

Dear TW
Thank you for taking the time to contact How’s My Driving regarding the incident involving a Tesco driver.
Tesco takes every report to How’s My Driving very seriously and all feedback is passed directly to the relevant transport manager in order that incidents can be investigated promptly. The safety of pedestrians and other road users is our top priority when on the road and we are disappointed to hear about the incident on the A1203. All of our drivers have undertaken specific training in relation to cycle safety in order to heighten their sense of awareness with regard to this potential hazard.
In this case, the driver involved has been interviewed with regard to the consideration he gives to cyclists on the road as highlighted in your complaint. Appropriate action has been taken to ensure there is no repeat of this conduct.
Please accept our apologies for the incident and be assured that Tesco will continue to ensure its drivers exhibit the highest standards when on the public roads. Again, thank you for bringing this matter to our attention.
Yours Sincerely
Meh.
Don't they know I've moved on? Today's close pass brought to you by some other twat in a van.

Looking to request some CCTV footage from a bus to review after a sketchy pass this morning. I've found it's stagecoach who operates the bus on behalf of TfL but there doesn't look to be an appropriate contact method on their website and instead it looks to funnel it through to TfL for any comments which itself is just a form on the webiste. Is this just the route that has to be taken to then hope it's passed through quickly to Stagecoach? Or just email to the 'accident matters' address they've provided for example and see where that gets me?

Don't bother with TFL, they'll tell you to contact the operator.
Don't forget to demand the footage you're in and quoting GDPR -

Had thought that may be the case from things I've read in this thread and others, cheers. Thanks for the further advice also.

Ah that's great thanks, didn't have as deep of a search as I thought whilst skimping off work to look when I got in this morning. Much appreciated.

@Cazakstan got some interesting footage.
At the same time, I'm not saying you're not allowed to feel nervous or anxious, that is completely understandable, especially since they threatened to kill you! I'm just trying to assuage your fears a bit, I'd say someone who'd be thick enough to try threatening you after being summoned to court would probably have been thick/brazen enough to actually try something at the time, not just shout about it.
