Cyclist really don't help themselves sometimes, two examples today
- HGV reversing out of a building site being helped by builders on a very narrow road. All traffic stopped doesn't stop a few cyclist from riding through the little gap between the HGV and the pavement. A few minutes later it was all clear to go.
- HGV stopped at the red lights inside the ASL box waiting to do a right turn on Gracechurch street, female cyclist pulls up right in front of HGV I'm over on the left going straight on I shout that's not the best place to be, she doesn't/can't hear me, so start waving at driver of HGV and pointing in front of him he sees me and gives me the thumbs up.

Something similar the other day.
Bus is indicating to turn left so I move right to filter however said bus has actually flashed the car coming the other way to turn before him, I notice through the windows of the bus some nob has gone up the inside of the bus so I start waving at her to stop she looks frustrated but then a stream of kerbnerds (top name) all fly through and she realises why and gave me the thumbs up. #csb

If a car had run a red light and caused brain injury to a pedestrian I'd hope to see the driver get a custodial sentence. Same with this, to be honest. Assuming this case is as clear cut as it seems to be from the articles, I feel the cyclist got off lightly - I appreciate that seems to be because 'cycling without due care and attention' apparently doesn't allow for a prison sentence...

I assume, they prosecute the offence, jumping red light / cyclist without due care and attention, rather than the outcome of that office, pedestrian in a coma.
It would be great if all drivers guilty of driving without due care and attention end up in prison (most don't).

'wanton or furious cycling' is usually the charge when cyclists cause injury, I think.

For the equivalent driving offence resulting in a serious injury an £850 fine would be considered pretty tough and a good result, especially if the offender pleaded guilty. From what I can see running someone down on a crossing or at lights and causing permanent damage usually results in £250 -£400 and 6-7 points.

Maybe not the thread for armchair legal musings, but I've always wondered why they can't just create some catch all offence of "killing someone, even though it wasn't murder it was clearly your fault and you were negligent". That could cover motorists, cyclists and chainsaw juggling enthusiasts under one big net.
As it stands the manslaughter law (that I though was supposed to cover accidental killing) only seems to be applied to deliberate killing, like a sort of "spur of the moment murder".
Edit - Plus a "causing injury" variant for when the act doesn't result in death.

Guy with a massive baggaboo, a radio and combats blasted through Old St just as people were trying to cross on a green man. Cue me having to say 'what a wanker' to the miffed peds to try to reinforce the point the rest of us has stopped.
Then five minutes later on Hackney Rd, I misjudged the traffic slowing and had to do a slithery skidding stop (yes, I have brakes) and ended up slightly encroaching on the person behind me's line. Sorry, whoever you were.

It would be great if all drivers guilty of driving without due care and attention end up in prison (most don't).
Our prisons are already massively over full and there is no evidence that prison sentences do anything to improve people's driving.
Edit; I'd like to see more longer term bans, life time bans for serious offences.

this may come as a surprise to you, but prison has the added bonus of keeping people who kill people with vehicles away from cars in much the same way as it keeps people who shoot people away from guns.
Bin dun. My mate 90s Brian couldn't drink because kidneys or smoke because lungs. He was a sickly youth. He used to wait until we were all wasted then charge us to drive to the 24 hour BP to buy Lion bars.
