Yes the council have some responsibility but if they've taken all reasonable steps to insure that somebody is fit to drive it would be hard to find them liable.
What checks do other council do ? what risk assessments do they have in place, would it be reasonable for all drivers to undergo a medical before being given a job (I don't know). But again this all seems to take away from the individual's responsibility not to be a lying cunt.

Not quite. If the CPS decides not to pursue a case, you are perfectly able to bring a private prosecution, but the CPS may decide (if they consider that there is insufficient evidence for a realistic prospect of a conviction) to take over the case with a view to ending it. However, an administrative decision of the CPS not to bring a prosecution does not prevent anyone else from doing so.

What could be the outcome of a private prosecution ?
The same as if the prosecution was brought by the CPS, if the accused was convicted. The sentence would be determined by the statute creating the offence, and would be carried out in accordance with the Sentencing Council guidelines. The driver's insurers wouldn't be involved - they'd only be involved where a civil claim for damages was brought by a person injured by the driver or by the relatives of someone they'd killed.

His insurer may argue they were misled.
I very much doubt there is an insurer in this case. Given that the driver was working for a local authority, it would be the local authority's obligation to insure him and the vehicle, and my understanding is that most local authorities are self-insuring rather than relying on outside insurers.

Lovely moment with a Sainsbury's delivery driver, who, after pulling away from his latest delivery just behind me, sat right on my wheel for about 15 metres until we got towards a pinch point where, predictably, he decided to cream it past me as we entered it.
He then went all the way around the roundabout just after it offering me ample opportunity to flip the bird and shout "thanks for that mate".
This enraged him hugely so he U-turned and then pursued me back over the roundabout until I stopped.
Cue an exchange of opinions where I at least started by calmly explaining that overtaking into a pinch point is very dangerous. In return, the usual bollox about "being in the middle of the road", "not getting out of his way", "middle of the road not being for pushbikes" etc etc. A brief flurry of swearing from us both ending with him telling me that "cunts like you deserve to die".
Pleasingly, as this was right by my flat, and as I get my weekly shop delivered from Sainsbury's, I'll probably see him again soon, hauling my groceries up to my door.
