• Just written to my MP up in Rural Aberdeenshire, Andrew Bowie, will see how he responds!

  • My MP Came back with -

    “Dear Mr McAuliffe,

Thank you for taking the time to write to me on this important issue.

The SNP agree that Vulnerable Road Users should be removed from the scope of the UK Government’s personal injury reforms and we will work cross-party to amend the Civil Liabilities Bill when it is presented to the House of Commons to address these issues.

I hope you find this useful. Please do not hesitate to contact me in the future on this, or any other, issue.

    Yours sincerely,

    Pete Wishart MP”

Which is encouraging, but Big Country and Runrig have not gone up in my estimation

  • Quick update:

The Justice Committee have just released a report on increasing the Small Claims limit:

    https://www.parliament.uk/business/committees/committees-a-z/commons-select/justice-committee/news-parliament-2017/small-claims-limit-personal-injury-report-published-17-19/

In short, they have significant concerns and said that "the small claims limit for personal injury should not be increased unless Ministers can explain how it will make sure that access to justice is not affected."

Their concern is the same problem Litem is trying to address - the "lack of legal representation" that will be caused by the changes.

The government didn't listen to the recommendations of the Justice Committee on the discount rate a few months ago, so it is not clear what the impact will be, but it is definitely positive.

  • Dear Mr X,

You recently contacted me about the changes in the small claims limit in relation to vulnerable road users, and I followed up your concerns with the Secretary of State for Justice David Gauke. I have now received a response, as attached here.

Mr Gauke's response explains that the whiplash measures in the Bill will only apply to the occupants of a motor vehicle, and other more vulnerable roads users will be excluded. He also outlines why the Government feel now is an appropriate time to raise the small claims limit for personal injury claims, as well as explaining the Government's reasoning behind the decision.

I hope this has been a useful update, and please don't hesitate to contact me if you have any other questions or concerns.

    Best wishes,

    Justine Greening MP

  • I didn't know this thread existed but I've sent some feedback to @ojeffcott, @AlexJ

I used the site to email insurer of driver that rear-ended me. I removed the costs bit because I don't havea total yet. If you want to discuss the feedback let me know, I can send it via pm if Oliver is too busy.
