  • Crown Office says it will appeal `lenient' sentence.

  • Result.

Thanks for posting that and thanks to everyone for writing to the Lord Advocate, hopefully it will result in a custodial sentence and a permanent ban.

  • Just got the email now, let's hope a fairer sentence is handed out this time!

  • ace!

I'd like a harsher sentence myself.

  • Fairer for the victim(s) but maybe I was a bit ambiguous.

  • :(

The Crown Office has lost its appeal against the sentencing of a man whose driving caused the deaths of two cyclists.

  • Lost for words

  • A ban and community service for taking someone's life (for the second time) is absolutely sickening

  • Utterly farcical. No mention of the stupid helmet comments?

  • I can't believe it. I signed the petition, I just can't believe that he's effectively gotten away with killing two people. It feels very unfair.

  • The British judicial system is fucking appalling.

  • Seems the Scottish isn't up to much either.

  • So there is no hope........we will never see an effective or positive change to protect the vulnerable on our roads.....cars are still the most important thing and the future.......I better learn to drive then I suppose, can get away with anything inside them boxes......

  • Absolutely disgusting result. I hope karma visits him one day

  • Fucking insane.

Life is cheap people. The liberty of a total fucking waster is obviously cheaper and more preferable than respecting that of a good person who liked to ride her bike and didn't abuse anyone in the process.

Why the fuck should people pay tax at all if the very things we're paying for serve to do nothing to protect the people we care for? Big society my fucking arse.

  • ^ this.

A sad day. The Scottish "legal" system should be utterly ashamed of itself.

The verdict in this case is wrong, but it has had a huge profile. Some of the next cases like this (I mean, I'd hope there won't be any, but unfortunately there will be) will be handled differently. It may not be the very next one, but just the huge media attention, and the sense of injustice and/or revulsion felt by many, has already made a difference. Cold comfort, I know, but there is a push all around the country on this area of law.

Is there though? There would need to be a complete overhaul of the culpability measuring system. At the moment it's a very big jump from driving without due care and attention to death by dangerous driving.

  • Was sort of expecting a "Hahaha, you all fell for it trollface.jpg" post to appear... This is ridicules.

  • we can no longer (if ever) guarantee the integrity of the justice system or the police when they waste time and money trying to keep the power away from the people who they serve.
most of em don't give a fuck about us, and the ones that do can't do anything about it anyway.
    R.I.P Audrey Fyfe

They found that he had erred in law in taking that into account, but that it did not, overall, contribute in a material way to the outcome.
