  • Yes talk to a lawyer. LCC or CTC lawyers will give advice to members but may not be able to do the work for you on a small non-injury claim. The insurance company policy will be to delay and frustrate you in the hope you will give up, that's how they make profits. It may be that you have to start a small claims procedure against the driver or his/her employer before the insurance people take notice.

  • After a bit of anxiety, the insurers have confirmed they will accept my claim. Feel very relieved to be able to put this all behind me and not be out of pocket. I don't think I'd have got this far if the police hadn't attended the scene, so it goes to show if you're in a collision, even if you don't think it's particularly serious, get the cops out.

  • Collided with a car in Peckham yesterday afternoon.


    I was in the new green cycle lane approaching Camberwell College, a bus to my right slowed and beckoned a driver across his path in order that he could enter the Total Garage. This obscured my line of sight and that of the driver I didn't see the car turning into the garage and the car didn't see me. I reacted but it was too late. I went over his bonnet at about 13mph.

    Landed on my face mostly. Got some bumps and bruises on my shoulders and chest. Spent a good 6 hours in King's. Was unconscious for a bit apparently.

    So my injuries are painful but I will heal. I don't want to cause the driver any unnecessary grief but I need my bike fixed, my helmet replaced and I need new clothes 'cause the paramedics cut mine off me and some of them were nice but a bit pricey. The police were on site I think so there is an accident report somewhere. I know the driver stuck around too, I think he even called the ambulance.

    I spoke to the legal firm everyone here recommends and they said they won't take a case that is worth less than £25k which is fair enough.

    I just wanna contact the guy and let him know he owes me a little shy of 900 quid for repairs/replacements.

    Anyone know what the appropriate course of action is? Call the police and ask for his details? Do I need a solicitor for that? Can it just be done via his insurers?

    A friend of my got knocked off his bike and is dealing with the driver's insurer directly,seems much quicker. Give Brixton Cycles a call, they have a solicitor they recommend, can't remember who...

    I think it's a general thing across the industry, but I could be wrong.

  • It's not.

    To answer the question - if you have / can get the driver's details and only want your stuff fixed drop them a line and ask for the money.

    If they say no, claim on their insurance. So call their insurer, explain the situation, give them what they ask for - which will probably include the police report - and hope for the best. They may try to mess you around. They may not.

    If you are a member of the CTC or British Cycling it's likely you can use a service to do this for you. This will typically be a larger law firm [Slater Gorden for example] with cheap legal execs doing little more than administrative tasks that these claims require.

    Note - if you make any kind of settlement you can't ask for anything else later, so if it turns out you've received some nasty injury you'd not be able to claim again to have it addressed.

  • Mine still hasn't been settled after 2 years... Partly due to a complicated per existed knee injury, partly because I never remembered to reply to emails... Ever...

    Whichever you decide to do, like Howard's advice, make sure your injuries are all settled or made clear before settling into anything...

  • I think I might give up cycling. In hospital again. Van slammed on his brakes after a cyclist tapped on the side of his van. Van came to a complete stop. No where for me to go except into the back of him. I thought I had left plenty of room but apparently not. I definitely wasn't expecting him to perform an emergency stop based on the fact there were no hazards in front of him. Police got all his details and I've got a witness too. Oooowwwww. First time on a board with all the neck thing. That's almost as painful as the actual injuries.
