  • I see. Normally I try and land on my face but obviously physics and surprise played a part here so I couldn't go 'full value'.

  • Supply a copy to the insurer? I can’t see any issue with it but I am not a lawyer so I am not sure.

To be honest by the time I was due my assessment, all my bruises are gone and the doc just sort of take whatever I said as fact. I showed him a couple of pics on my phone too. No viable injuries doesn’t mane you are fine though. I went thought a period of about 6 months of feeling shit scared pn my bike at junctions as I was hit at a 4 ways junction.

We were going to go for psychological damage too but it would have made my case a lot more complicated because I had a lot of stress from work at the time and so I had been to the doctors for stress etc. The advice from my lawyer was that the insurer will likely drag me through the mug and could cause me more stress and will likely to attack me using my previous stress related stuff. Had I have a stress free medical record, then we would have gone for that too.

If your medical record to date has no stress related issue at all then it might be worth looking into that. Everyone is stressed and scarred after an incident like this.

Also, I take it you have already been to your own doc about the pain etc? If you haven’t, do it now. Keeps going back to say you are still in pain, the final settlement will depend on the independent assessment as much as your medical record.

  • Me, stress? Ha. Only at the state of the fucking planet and the morons on it. :)

I went to the GP but she didn't have a clue. She did print out the A&E report though.
I was going to speak to my physio if I was still damaged in a week or so.

  • Well the first thing is to get the legal people on board. It’s dead easy tbh, I used a bunch based in Liverpool and they did most of the legwork, altho I chased plod up when they dragged their heels on the cctv footage.
In the end they took so long that LT had wiped the footage but I got sworn statements from two coppers who attended the scene and viewed the footage while at the station.

But yeah, get things moving on that front.

  • Everything has been 'kicked off'. I'm not giving solicitors 25% (yet).

  • I'll do it for 24%! I'm well gooderer anysways.

  • If you can get me 150% of what I would get, you're on.

  • If you can get me 150% of what I would get, you're on.

    A solicitor probably can...

  • Who do you think is going to work harder at getting the most money from the driver? Me, or the guy who's already blown their 25% on lunch?

Lunch may or may not be cocaine.

  • The guy who's concern it is to make his 25% bigger and also knows more of the law and things you're possibly entitled to than you do?

  • I'm doing ok so far. I've been forced to travel to the office in a helicopter, my doctor is based in LA and the experimental surgery has so far cost £millions ;)

"You should speak with a lawyer if your case is complex e.g. if the defendants want to fight the case or you have suffered serious injury. However, most cases can be settled without instructing a solicitor. Our tools and guides provide everything you need to settle your injury case directly with the defendant's insurer." https://litem.co.uk/

  • When I'm sending the insurer costs for damaged shit, what do I do with weird stuff like my broken shoe? The shoes were bought second hand off ebay but then had £x spent on it converting it to midfoot. They're not available any more. So do I send the ebay receipt if I can find it and the midfoot conversion costs or so I send them the cost of the current equivalent or what?

  • Do I have to account for depreciation for my old skid lid?

  • Cost of new, plus quotes for conversion.

If only you knew friendly bike mechanics and shoe fettlers...

  • I know I can get the quotes I just didn't know if I was supposed to provide receipts for what they actually cost me or if I was supposed to provide 'as new' costs. Do I need to factor age into new costs for depreciation?

  • Go for as knew.

It's not like they'll ever offer higher than you claim for...

  • Okay, any idea what a Shimano R131 equates to in current range? :S

  • Winter and summer covered.

  • Those would look good with a pair of under the knee white socks.

  • I've ordered those as well.

  • But you already have them, why buy more?

  • They didn't go high enough.

  • So, insurance company have come back with compensation offer (this doesn't include my losses which are still being calculated) and are saying if I reject it I need to instruct a solicitor to continue with the process.

Is it possible to reject their offer and then just try it on myself, arguing that I should receive more compensation? Or is it just a case of taking the money and getting on with life?

Tempted to take my costs tally and add it to a bumped up compo value and send it back to them for discussion.
