  • Some driver drove into missus' bike while she was waiting for lights, she is absolutely fine, the bike damage is substantial. The driver was apologetic and helpful and has given details along with his business card, number and his company ID photo. She also has a witness who is more than happy to help.

    What are the next steps? Didn't call the cops yesterday as she didn't feel the need to. The driver is going to call her today to discuss further. I am guessing the only thing she can tell him today is the bike will go to the bike shop for damage assessment and a quote to make it roadworthy again?

    The question to ask is would they like to pay out of their pocket, or would they like to pay from their insurance, and if the later, the details of their insurers, please.

    Actually fuck it, just ask for the details of their insurers and ignore the driver.

    She says she's okay and the bicycles okay, but what do you do when it's not okay.

    Assuming this was entirely the ped's fault, and you have hit the deck and are not in any immediate danger - don't get up. This will make other people more likely to help you, and make it harder for the ped to leave the scene, assuming they can. The process would then be similar to an incident involving a vehicle, in that the police and medics will show up, details will be exchanged, and at some point you will try to recover costs through the ped's insurers, be it their travel insurers if they are a tourist, or their home insurers or other indemnity provider if they are a local.

    3 weeks ago, @Kazakh was rear ended by an inattentive but apologetic woman at a junction. @Kazakh did not check properly for damage at the time because the woman in the car was randomly subjected to a vile verbal assault from a knuckleheaded bystander, and in the torrent of racist and sexist bullshit both left the scene. We have since been away for holidays.

    I went to true @Kazakh's wheel today and found it dangerously bent for a low spoke count wheel, un-truable, and very deeply scratched on the braking surface. Basically written off. We have emailed the woman driver with the cost of a replacement rear fulcrum racing quattro, around 150. Obviously, we dont have the number of the idiot who started abusing the driver, who was the only witness. If the driver refuses to help, what is our position?

    I've got front and rear camera footage.

    It's best to be proactive with police. Make sure you get your footage to them asap. They also need to be motivated to know it's a clear-cut case and one to deal with.

    Annoyingly, and slightly absurdly, if your crash didn't result in injury to you (which we obviously hope, but as you went to hospital, it sounds as if there were reasons to take you there), it'll be a lower priority for them than personal injury collisions--there'll be the expectation that you and the driver sort it out between you, e.g. through his or her insurers, if it's 'only' property damage.

    I don't know much about the legal side, but obviously @ojeffcott would be someone to give a quick call. He'd be able to ask you the right questions quickly and be able to advise you whether it's worth pursuing.

    Who do I send it to though? I've got a crime ref number on a slip with driver details but no cop details. If I miss a day's work because I'm at hospital and I have to take painkillers to move then I'm going with 'damn right it's personal injury'.

  • You should be able to take it (or, indeed, send it) to a police station local to where the crash occurred, as it's likely that local officers attended. You don't need to know the names of the actual officers, they'll have those. The crime reference number should be all you need.

    Yours would probably be classed as a slight injury, then (out of slight, serious, or fatal). Definitions here (I've rejigged the text slightly):

    Glad you don't sound too badly injured.

  • Is in-patient only if you're kept overnight? They kept me there (not overnight or anything) for the blood tests to see if I was bleeding internally and for piss tests to see if I had blood in my urine (the bonus of being on anticoags I guess). The nurse said a coccyx fracture can only be 'managed' anyway, like ribs and collarbones they can't set it. But given I didn't have any specific pain near bones they didn't bother with any scans.
