If you can get hold of a copy of LCC or visit lcc.org they may have some links to solicitors helping in bike accidents

Just seen this, might be helpful?

Not sure if people are aware but if you're hit by an emergency vehicle they should have a black box which records use of accelerator, brakes etc. Some private vehicles have them too.

can anyone give me advice as i was hit by a car being let out of a t junction by a stationary lorry as i was overtaking the it..i have the mans details who hit me, witnesses, and the man who hit me was real good and was extremely helpful..he said i can claim off his insurance but i am uncertain how to approach this? my face is pretty mashed, loss of eyebrow..deep laceration down to the skull..so there will be scars and i will have no brow..also deep to the bone laceration below the eye and above my lip all of witch needed internal and external stitches..my 370 pound Oakley glasses were destroyed too. the bike is in perfect nic..just untrued both of the wheels a bit but they can be sorted..also i will add that a cop saw it all..
i will be grateful for any advice you can give me..thanks

Nyquil,
Please see the first post on this thread. It will talk you through.
Basically:
Call the cops.
Demand justice politely.
Take good notes.
See it through. -

i was in a accident yesterday
i don't think it was my fault but its not for me to decide,
any way the man wanted to do it outside of his insurance because off excess and no claims, and wanted me to pay for it
i said insurance is for accidents and its there for a reason, but the he went on and said he didn't want to loose his no claims etc
at this point i handed the phone to my dad because I've never had an accident and not sure how it all works, there was a bit of arguing then some one hung up (not sure all i saw was the phone put down)
i rang the police, told them everything, they said they always recommend putting it through the insurancewhere do i stand with this?
i didn't get any witness because i was in the back of an ambulance and not really sure what to do, i thought it was just an accident, what happens if they think its my faultthanks

hey dean - what actually happened in the accident?
-
• #191
How did the accident actually happen? If you can describe it that would help.
That said **all the stuff on page one of this thread is brilliant **and a good yard stick to follow.
If someone doesn't want to do it through the insurance there are a number of reasons 1) he hasn't got any 2) he's at fault and trying it on with someone younger and less experienced than him 3) he wants to save the no claims bonus. Of the three 1 & 2 are most likely.
But ss I say follow the procedure as set out at the start of this thread.

oncoming traffic (2 lanes)
the inside lane (turning right onto balgores lane) was backed up as far as i could see ( the bit of lane before the box was filled, the box was free and there where cars the other side of the box) the box junction was open. the outside lane was free for about a 2-3 car lengths (trhats as far as i could see)
as i turn right into heath drive a car came out of nowhere (coming down main road) and i hit the wing and door resulting in a broken collar bone (which is twisted, i need to get it check out properly, one doctor said it needed surgery and the other said it didn't so i still don't know what i'm going to do yet)
i cannot remember if the outside lane (to go strait down main road) was up to the box ( in between the lights and the front of the box, i think it was) or not and the man was coming across it or if the lights had just changed (every other car was stationary)the man has insurance and i have his details, the police gave them to me
if it is my fault what do i do?
ive rung the bloke and he started getting really argumentative down the phone saying he didn't want to take it through his insurance and he wanted me to pay
i can see his point about losing out on his excess and no claims ( EDIT i have been reading up about insurance and realized he chose how much excess he has so it isn't my problem)
but an accident is a accident -

Sorry to be of no help but from your description - i.e. you turning right across oncoming traffic and then you striking a car that is 'undertaking' (for want of a better word) the stationary line of traffic, I have no idea where liability lies. I bet others will know/have an opinion.
Sorry to hear about your injuries - heal up fast.

Got knocked off my bike yesterday, the front wheel is messed up. The guy who did it said he would pay for a new one if I got him a quote, problem is I have no idea what the model or make is, could anyone help me identify or give know of an equivalent? It's off a standard langter skull and cross bones model...
sorry about the crummy pictures, not sure how to take pictures of a wheel with no name haha
-
• #196
contact a specialized dealer, there give you a quote for a new wheel
is the rest of the bike ok?, fork blades, crown and steerer, around the head tube, cracked paint, bulges in the tubes, tears/cracks in the tubing/welds ? -

1234, you should get legal advice if you haven't already. A solicitor would be better-placed to help you along than we could. Sorry to hear about your injury. Best wishes for effecting a satisfactory resolution.

bit of an update
went for private med care today, clavicle is basically screwed, its not a normal break, the 2 halves are overlapping horizontally which helps them join back together But there's a big gap vertically, so its not got that greater chances of knitting back together, if it does though i loose about a 1 1/2 - 2 inches in width on my left shoulder plus i get a decent size bulge chucked in for free, if it doesn't start to join i have to have a bone graft (taken from the outside of my hip) and/or have plates and screws (theres some risk involved because of where it is, nerves to my left arm, veins and my left lung)
bit of a dilemma tbh, im not sure whether to go straight for the plates and screws or to see what happens, dont want to have surgery if its not necessary ( if i do i would prefer not to be nocked out, prefer one with a numbing injection, if they can, didnt really discuss operation details) going back in 3 week to see if its started to join ( if i dont decide to go for surgery beforehand) then i will way up my options,
some people have it worse than i so i cant really complain, i got of lucky as it is, not had any pain since it happened (wether thats my pain threshold or luck) bit uncomfortable with this collar and cuff thing but thats it, its a bit of an inconvenience as well,
in a weird sort of way i have enjoyed the problem solving bit, having to think of new ways to do stuff with one hand, takes a bit longer though
legal bits are, co-op think im fully covered with household insurance their just finalizing it, cctv is pending, and olly (ojeffcott) has offered me his services if i want to put in a claim
think ive covered it all
@oliver thanks fella -

You're on the right track there. ojeffcott has helped others on here. Sorry to hear about the complications with the break!

Found the make and model,
Mavic MA3..... anyone got one?
this thread is going on my desktop stright away
when i was hit, but a complete idiot i did none of the above 'sensible things'
the driver shouted at me for making a human shaped dent in his car, and witnesses just carried on about there business, only one man asked if i was alright, as he offered me a fag
and then i cycled to hospital with a shattered collarbone
but now, if (fingers crossed) i have anoter accident i wil know how to go about dealing with it
but i was younger and more niave then i am now, just a little though
