How would you know the questions have not been asked? What do you think happened when the framework for our league system was developed. I hate to break this to you but this is such an extremely complex problem that you're not 'thinking outside the box', you're just chatting the type of shit you would hear down the pub. It can broadly be summarised by 'there's no smoke without fire'.

The legal system goes out of its way not to introduce unnecessary bias by not basing convictions on previous actions. You should probably try to figure out why before your posts shake our league system to its core.

Be fair, this is at least wine-bar level shit or possibly even dinner-party level shit that we're chatting here.

Jeez's suggestions aren't a priori ridiculous and "this has all been thrashed out before, go and read this book/blog" is a perfectly valid response if you can direct him to previous discussions. There's no reason not to discuss this here except that we can't be bothered. I really don't think we're going to resolve anything and, since I don't have enough knowledge of the law, I'm no longer contributing.

You're not "learning" here, matey. You're looking for get-out clauses to find circumstances under which having intercourse with somebody who does not consent does not amount to rape. You ain't gonna find those clauses, because they don't exist. Only the nastiest, least self-aware, most inhuman cunts try to find those get-out clauses, and they do it because they do not respect the agency of other individuals. Take care you don't find yourself slipping into that territory.

This is pretty much the problem. This is back to the original point from that article I posted about how society as a whole is very unsupportive of any instance of rape that isn't coercive because they don't understand how, if violence or aggression isn't being used, the victim can't just walk away or say no, so if they let it happen they must have consented to it so it's not rape.

Like Boths I don't really want to get into all the different types of rape but try looking at the girl in America who got drunk at a party and was gang raped by her school's football team. A large percentage of people then blamed her saying she was drunk and said she probably consented at the time. Do you think she really consented to being gang raped? Also, do you think those guys seriously considered themselves rapists for doing it? No, they would have seen it as having sex with a girl who was drunk, in their minds it wasn't rape because she might not have been screaming to get away and they weren't physically holding her down. However, it is rape and the public opinions supporting the rapists and wringing their hands when they were sentenced to jail shows how much work needs to be done to inform people.

So I think it's good to have these discussions in a public forum because a lot of people are naive and just don't think about it, which is understandable because it's a pretty grim subject so naturally people want to avoid thinking about it or actively learning about it. However, the culture of not talking about things that make us uncomfortable and being ignorant of where the boundaries lie means that creeps (male and female) can get away with a lot, not only because the people around them don't call them out but because* they themselves don't realise it's wrong*. This is why the warning signs are missed when someone goes from being a harmless perv, someone who doesn't respect personal space perhaps but wouldn't actually violate anyone to a proto-rapist i.e. someone who would rape if they had the opportunity (sorry BQ if you don't like that word but it only applies to a very tiny minority of people, it's not accusing 'all men' as you think). Because if the first actions are too 'grey area' to be rebuked then they would have the confidence to move on to more serious actions and still feel immune to any kind of reprimand.

That's my thoughts anyway, I'm not an expert or deeply involved in this subject nor do I have a solution I just read a few articles last week that were quite thought-provoking so I wanted to share.
