    Doubt it. I got hit by a bus as I was letting someone cross on a zebra crossing coupla years ago. Went straight into the back of me, knocked me flying off my bike round the side (thank fuck not under) as my bike was crushed underneath.
    While I was being helped into the ambulance I could hear the driver trying to convince anyone she could it was my fault. She didnt give a fuck about me, didnt even come over to see if I was alive or not.

    After 6 months police dropped any charges of dangerous driving or whatever it was.

    Its good you are ok and not harmed at all, but if she has to do a bit of retraining so she knows you cant drive through a cyclist, then thats a good thing.

    Now why am I under the impression that the previous incident didn't go through the official channel?

  • I would normally recommend reporting all crashes to police. We need those reports even if there was no personal injury (too much stuff goes unreported). If she's clearly apologetic and if by dealing with it good-naturedly she will be motivated to improve her driving, there are of course other ways of handling it. Glad you weren't hurt!

    Likelihood is they will pay up superquick, new back wheel is fuck all for some of these transport co's.

  • Was worried when I read the thread title, glad your ok though.

    I was nudged forward last week at a junction by a car which wasn't even aware what it was doing. Some drivers need extra training, don't let them get "away" with it.

    Sorry to sideline that not training needed getting a fucking grip of what you are in charge of.

    I really can't comprehend how a professional driver is unaware of two cyclists in front of her vehicle at a set of red lights. My suspicion is that she was looking at the bus stop that was 50 yards down the road rather than at the traffic situation but that is no excuse for something that may have had very different consequences.

    The bus company have been very helpful and played it all with a very straight bat - the impression I get is they know they are very liable if the CCTV substantiates my version of events [I was told that there was a 10% chance of there being no footage but there were made very aware that I had independent witnesses]

    as always a big thanks for the pm's and the advice from them and also the important 'what to do in case of an accident thread' - it seems getting independent witnesses has put me in a very strong position…

    Says the fellow who threw an MTB at the windscreen of a bus he had an altercation with!

  • I had a bendy bus move over and nearly squish me against the railings on London Bridge. I had to hop off. I went round to the driver and asked what he was doing.

    "You undertook me at Monument!" He said.

    "In a different lane! What, so that was revenge?" I asked.

    He shrugged.

    I think I did complain and got a standard email.

    They are not--there has been work done by the Transport Research Laboratory which has had a project of attending crashes whenever possible and recording them. However, the police are the most consistently-resourced to do this and they obviously have statutory duties, too. There has been a lot of criticism of the STATS19 system used by police to record crashes; it is a pretty tall order for a PC on the scene to accurately record a crash just from on-the-spot witness statements etc.

    "I don't think I was in the wrong and I won't sign an indemnity form until I am happy that there are no physical repurcussions from the incident and may I see the CCTV so that I may corroborate that with my independent witnesses report"

    *at the end of the conversation the bus driver had magically produced a witness [ even though my independent witness will acknowledge that he was the only other person who had stopped and remained at the scene. I then informed them of the driver phoning me 15 minutes after the accident and the following day asking to pay for any damage to avoid having to fill out an incident report and this information has gone down with the accident investigation team like a cup of cold sick, naughty naughty bus driver

    Cock munchers… I would have let it go if the driver hadn't started playing silly beggars with phantom witnesses

    Can't work out why they would offer a goodwill gesture payment if the driver wasn't in the wrong

    By 'front of bus' you mean the bus is literally behind you and not on the side? (i.e. centre of the lane), I must've missed this if you did mentioned this already.

  • Defo get the CCTV, and speak to LCC if you haven't already - they haz good lawyers.

  • yeah sounds like they are trying to kill the case and prevent any liablity for injury/damage beyond the goodwill payment which is what they will see as the risk.

    speak to a solicitor, make sure you know what you are arguing etc which it sounds like you do and just do what you think is right/most appropriate

    I think the point (of the above statement) is to tempt you away from a legal route by dangling a few quid on the end of a stick because they can see that if this went to court they would almost certainly lose.

    Ask them right now (phone them !!) if the CCTV footage exists, if it is in their possession. You need to put them in a position where they cannot claim there is no CCTV.

    If they tell you there is no CCTV then ask them on what they are basing the idea that you were in the wrong ?

    Besides the bus company CCTV are there local/council CCTV cameras around that junction ?
