Good work, David.
I don't think he can really do anything in court apart from advertising LFGSS. -

Did you not point him to the liability of content policy and show him some chevrons?
Also - is the forum not covered by the "mere conduit" section of the EU Ecommerce Directive? Are you or are you you not considered a service provider in this instance?

We are a service provider, I've said so throughout and this is why we also don't moderate (to prevent becoming publishers with an editorial policy).
I tried to mediate solely to reduce headache for both parties (not me... the users and espresso cycles), but frankly if I'm doing something like that then people need to work with me rather than hound me via Gmail and GTalk... I have patience and am willing to consider any perspective in an argument as being potentially valid... but if my patience is tried I'll be damned if I'm going to spend my time and energy trying to help when there is absolutely no need for me to.
Ultimately, I was performing the role of a magistrate, but since that was unappreciated espresso cycles can now hire a lawyer and spend real money to go and piss off a real magistrate. It will great simplify my work, as by the time it comes back to me the instruction will be clear and simple and not be a burden on me as the communication service provider.
I can say from experience that Sam from espresso/caramel cycles is a tit.

I don't think he can really do anything in court apart from advertising LFGSS.That's probably good, one of the posts he had a problem with was yours.

though in the meantime i must say, whilst I have no experience or knowledge whatsoever, from the photos I've seen online I am of the opinion that the components appear to be cheap, substandard and potentially not fit for purpose. additionally though I have no experience or knowledge of the bike builds shown on the espressowheels website, it does appear odd that so many of these random punters bikes appear to have been built with a disregard for safety and the legal requirement for 2 braking mechanisms
Mmmhmmm....

I have no idea, but I wouldn't just aimlessly go around and potentially mud sling random people who might happen to have the same name.
Look, espresso have made a fool of themselves... that is pretty much the only thing that needs to happen. No mob is required or invited, we can all stand back and watch the train wreck without having to hop on it for a moment.
