  • "The driver MUST BE BANNED FROM DRIVING ON MEDICAL GROUNDS."

    Good point. Is she?

"By law a daytime black out is an automatic ban for driving"

    Is it?

  • what more, why wasn't she's at least fined for using mobile phone when driving? there's evidence of that.

  • the more i think about this the worse it seems.

we are living in utter mono culture where drivers are bossing everything / yes getting away with murder.

    horrendous state of affairs.

Come on UK drivers? Anyone know about this shit?

  • imo this is the reason for 20 mph and enforced with speed bumps if necessary.

that way the range rover would have been travelling slower and even if it hit the cyclist may not have killed her.

  • britain - too dangerous to be green.

    nice one parliament.

  • thatcher was wrong. swampy was right.

    no more road building.

road building = too much danger in the community.

  • and of course the roads only get built using cpo powers.

    i.e. forcing landowners to sell.

cpo powers are only supposed to be used for the common good.

but now i think that roads are common bad.

  • rant rant rant......

    have a day off mate.

  • somebody you're verging close to becoming a daily mailer!

  • thatcher was wrong. swampy was right.

Ed; the day I read that in the Daily Fail will be a bright one :)

Ex g/f has a seizure on new year's day in abut 2003, and after spending the day in hospital was released, but had to give up license for 12 months, and would only get it back if nothing happened in that year.

I think that if you have a black out through head trauma or injury, you lose it, but if you have a seizure or fit due to a medical condition, so long as you can show it has been treated and you are not a danger to black out again, you will not get a ban.

    I think...

Not really sure I know if you have one epileptic fit then its an automatic 1 year loss of licence if you have a second or third then it extends for up to 3 years.

Just wondering if you get caught RLJ could you say you had a "funny turn" just before the lights and you didn't even notice you went through them?

  • "I'm blind drunk, officer"
    "I mean blind, officer"
    "I mean colour blind, officer"

  • So we should expect her to be off the roads for a year after this? And if she's not.. ?

  • Having looked at the DVLA and other sources, it is not conclusive. Given the information from the case, and stating it was mearly feinting, this alone I think does not constitute enough to ban her.

  • Why not? She's clearly a danger. If there's no evidence as to why it happened once, there's not evidence that it won't happen again. She should be banned.

  • I agree that she should. However whether this will actually happen is anther matter entirely.

  • Found what I wanted now.
    http://www.dft.gov.uk/dvla/~/media/pdf/medical/at_a_glance.ashx

In summary. no ban if just a feint, if unexplained and if low risk of reoccurance, 4 week ban, if higher risk, min 4 week ban if cause identified and treated.

Limits are upped depending on nature.

  • Sweet.. now I know why the UK has so few guns... it's coz you don't need 'em when you've got cars.

  • There isn't enough information available to judge either way. 'Lack of evidence' is one of the favourite reasons for doing nothing. It does sound suspicious--there are lawyers around who are able to get people off charges like this on technicalities. They have their price, so are available to you if you have the money. One's particularly famous, but I'm afraid I can't remember his name.

It is a well-known fact that the law in this country for dealing with situations like this is woefully inadequate and in dire need of reform, but government after government fluffs this.

    Tragic, infuriating, and sad.
