Gilera cx 125 single sided front and rear. Quite a lightweight bike

ER no, they need to pay for repairs to the bike, any equipment and a back hander to keep you in the same situation as before as if you hadn't had an accident.
Did you have a hire vehicle while yours was off road?
-
• #24604
No I didn’t. It’s why I’m chasing this up by myself. My insurance pressured me to have a hire bike whilst mine was being ‘assessed’. They got pissy when I said no.
Got an independent quote to a total, of which the TP insurers responded with half of it as the ‘value’ of the bike. I don’t want to replace the bike, I want to repair it. -
• #24605
In which case you need an independent assessment to damage and repair cost. This is normally how you end up with a financial write-off, purchase bike back, then repair with the money. Get to your mechanics and see how they could help write a quote up.
You can demand the bike to be repaired, so long as it is economically viable.
If the TP gives you a value you disagree with, counter it with evidence. Auction, fb marketplace, gumtree, more the better all proving your bike is worth enough to make it worth you pursuing in court if needs be.

Btw name and shame your insurer. They sound a pain.
-

What ever you do, do not cash the cheque if the amount isnt right.
Mine told me that it was fine to do it, they would send another for the upped amount.
I got totally shafted replacing my scooter like for like by a grand and after that they gave me the run around and i got no where.
"The other insurance company aint paying anymore and we can do any more" Absolute cunts.

This is already what I've done. They came up with a frankly slightly outlandish price, think original Triumph components, but it would have gotten the bike to pristine condition.
I'll give them a buzz on Monday to ask them to expand on the insurance jargon.
Insurance is Devitt btw. They're incompetent, their third party assessor, which is 4th Dimension (they assess for a LOT of other brokers) are outright fucking cons. Aviva, which is the actual insurer, have been helpful.@konastab01 The value suggested isn't actually out of line, it's just a case of vague terminology that's difficult to discern. If they want my bike as salvage, they can fucking do one and Ombudsman are getting involved.
-
• #24609
Aren’t 4th Dimension the ones that always demand your bike and then strip it for parts to sell on?
Sounds like you really do need some proper legal counsel.
-
• #24610
Also ombudsman won't do a thing until you have made an official written complain to your insurer and given them the appropriate 6 weeks response time. I know because I tried
-

So the assessor’s job is to value how to get the vehicle back to how they believe it was prior to any collision or incident. That means genuine parts and 100% legal and safe.
The insurer then turns around and says “We won’t pay that repair bill, write off the bike and we’ll pay what it was worth on the market”. At that point, where you are, you evidence the value of an equivalent bike on used market.
More evidence you have the better, but you should argue for maximum used value less scrap (ie £500) to keep it.
You can try to argue for repairs but in court you need to show you were being as reasonable as possible, and keeping costs as low as reasonably possible. That means not demanding a hire vehicle unnecessarily or demanding gold plated shifters.
In your position work out what gets the biggest financial return, and offer to be as reasonable as possible. Reasonable is? You give the evidence to prove your financial demands and accept no less.

If anyone is interested I have these Scott Recoil Speed Strap goggles going spare. Brand new, bought two sets and used one until recently.
£55 on ebay, I’d take £20 collected or £25 posted. I have a second used lens that you could use until scratched to hell, that I’ll include.
The speed straps (velcro connectors with metal buckles) are worth £15 on their own. I kept the set from the other pair to use on a different pair of goggles.

I hope you leaned as hard as possible to get your maximum reasonable result.
Remember, as soon as someone has admitted (sole) liability, that means they are liable… which means they are liable to pay for any and all damages occurred.
Oh also, based on your experience vs mine I’d have totally recommended Mcams to anyone.

Is Aviva the underwriter for your policy or the insurer for the other side?

This’ll be next move if anything happens for sure.
In the end it was value of bike not repair cost as that was about double.
Fought for the ten percent salvage cost too.@jackbepablo mine was Aviva, who to be fair, we’re a good underwriter and informed me of the third party admitting liability.
Devitt as broker didn’t know and didn’t seem to care. -

Ombusman were useless in my case, I wouldnt pine much hope on them doing anything.
-
• #24619
That's who fucked me, 4th dimension. My scooter was meant to be crushed because of the cat and it was on ebay 6 months later in the condition they collected it in for more than half of what the value of what I got. Absolute cunts

Crikey they're absolutely lovely!
I had a nice bike-weekend this weekend past and did Triumph factory tour on Sunday and NEC on Monday.
Triumph factory tour was good though I actually found the free museum bit at the start to be the most enjoyable part of it. Interesting to see where it all happens though and the amount of effort they put into their crankshaft line in particular is very impressive.
I was surprised to learn that Triumph build no bikes for stock, a bike only starts production when they have an order and deposit for it so any dealer stock has been chosen by the dealer specifically. They also build to order in a single production line so there's no order to what the next bike off the line will be at any time. I thought that was quite surprising!NEC was bike overload. Too much stuff to remember even but highlights were as follows:
Norton - Easily my highlight of the show, the V4CR is one of the most beautiful things I've ever seen though at £42,000 it would want to be. About as comfortable as a scaffold plank too. The Commando 961 LE Transatlantic was absolutely stunning too, a bargain at £19,000.
Krazy Horse Kustoms - Some super cool custom bikes with wild paint, probably not everyone's cup of tea but I liked them a lot. There was a particular Zero Engineering build with absolutely mesmerising paint.
BMW - R1300GS was deeply underwhelming but I rather liked the R18 Classic in real life, what a size though. I also thought the R1250R was quite charming and understated.
Ducati - I still really want a Desert X and the want has increased since having a proper look over them. Panigale V4S Race Spec was c.£50,000 of delight to behold!
Yamaha - R1M was the aforementioned Panigale for the buyer with better taste and really very lovely. Ténéré World Rally floated my boat a lot and then there was the XSR900GP which looks even better in real life and has some really lovely "period" features like the fairing and screen fasteners. Incredibly cool!
Kramer - KTM engined trackday bikes. So pretty. Look like an absolute blast to ride. Need to figure out if they could conceivably be road registered as a "KTM Duke 690" :)
Those were the real stand outs for me, there were lots of other great things like the Zero concept bike and the ZX10R with the retro livery too. Also some really cool classic and rare bits around like the bonkers Hesketh Vampire. Would recommend popping in for a few hours if anyone is nearby and has the time to kill!

Good to know, I bought through Devitt. My insurance is actually through AXA so hopefully I don't have to claim and wind up having a Velocio experience

A few bad pics from the Solvang motorcycle museum. Incredible collection of mostly race bikes a little way up the coast.
