Yep, sale of goods act applies as far as I know to eBay sellers. So the goods need to be 'of satisfactory quality' and last 'a reasonable amount of time'. The law really protects the consumer in this area.
If you're that annoyed Will take him to the small claims court, you can do it online now. By the sound of things you'd probably win.
Seriously Cyclingtopsuk, this is why you should HTFU and give him a refund. If your business model doesn't allow for compensating customers on the odd occasion, charge more.
The Sales of goods act does not extend to used items.
Our business model does allowing for compensating customers, and we do all the time e.g if a mistake is made in the listing etc.......

If you'd come on here and said 'we'll refund or replace it, no worries' you'd have seemed like nice guys, and might have made some more sales. We'd all think 'yeah, even if i goes wrong these guy's will sort us out, what sound guys' but now your just like ryanair, or the train companies, or npower, or one of countless other companies that don't give a shit.

Some of you guys know me. I run the eBay shop Convicts of the Road and I was the geezer on the lurid Eddy Merckx on Fresh's vintage jersey ride last week.
Generally speaking, most vintage jerseys are very well made - they're from a time before far east mass production and they've lasted this long because they're hard wearing.
I know from experience how hard it is to run a vintage clothing business on eBay. I'm a believer in karma so I'm not going to lay the boot in here.
Our feedback is usually around 99.9% positive with a 4.9 for item description. I say 'usually' because you obviously won't keep everyone happy and our philosophy is that every day you're a day closer to your next neg. Its unavoidable on eBay so you just have to do your best.
What I will say is that I agree with Villa-Ru above - the customer's always right no matter how daft you personally think they're being. We've never once refused a refund in three years, not even for sizing when we put detailed dimensions in the listing. What's the point in winning the argument if you lose future business?
The second point is that its better to be honest about what you're selling. If something has a fault we don't grade it as 'very good' - we say what the fault is and grade it accordingly. If you do something different then you open yourself up to a whole heap of problems.
We're obviously human and we do make mistakes and miss things every now and then, but I think that the best test of a business's customer service is how they react when things go wrong rather than when things go right.
i saw your ebay shop, you seem like great guys! i like how your supporting that rider who got knocked off. . . great guys, hope your business is going well!
I would also like to ask you this question:
if i were to buy a top from you which the colour ran so badly the top was un wearable even though i had washed with cold water and been very careful would you try and do something about it? -

We've never had colours run but we've had things like stitching come loose on jerseys after a few uses. In theory its not our fault but, if we give you a good after sales service you'll most likely shop with us again. If you're unhappy then you won't. Its not rocket science.

Stitching, i wouldnt mind too much about that unless say like a whole side came off after a few rides, i agree that they are vintage and they are not like new jerseys but i would expect a few rips after a while which could be patched up! you will have my buisness next time i buy a jersey :) -

My wife washed some expensive tops including a multi coloured one. One of the colours from that top ran and the whole wash turned pink. This gear took all the pink out completely. Brilliant product.
I cannot believe I'm giving washing tips on this forum. Off to crawl under a rock now or maybe paint my nails.

He washed it in cold water, yet states it should be washed at 40c. The jersey is defect, accept it - It would have run even if he was caught cycling in a heavy rain shower or something...

You bought the jersey, liked it, wore it and have now damaged it.
Once you accepted the item and wore it, thats where our responsilibity ends.

For Jerseys you want merino, or modern artificial fabrics.
Cotton is shit. It holds water, doesn't dry out quickly, doesn't wick away moisture, loses all of its heat retention properties when wet, smells bad very quickly. And it's a fairly heavy fabric.

About half-way down http://pages.ebay.co.uk/businesscentre/law-policies/listing-items.html you'll find the words "The Sale of Goods Act applies to both new and used items."

It's not really anything to do with the rights or wrongs. It's down to customer service and general goodwill. It's a part of running a successful business.
