For the rights of people featured in such photos see this long discussion on Moving Target about an image used by Kenda Tyres, which was purchased from Shutterstock, which boils down to: no model release required for news or editorial photos, but is required for commercial applications (advertising, catalogues).

One of the many people who have asked if they could take pictures of us. We said yes. I remember him being a nice enough guy. I do believe he even sent us a link/copies of the images he took.
