  • At first, I thought 'Folksetone Academy' must be a typo, but it's maintained throughout the article, and so must be the correct name.

    Surely a penis-like object is enough for unwanted penetration to qualify as rape?

    Also, by that logic, only men or people with penises can have actual sex, whereas everyone else using fingers, mouths, vulvas and other body parts and objects is just having sexual contact.

  • But rape can be by fingers or objects.

  • The legal definition of rape in the UK is when a person intentionally penetrates another's vagina, anus or mouth with a penis, without the other person's consent.

    It requires a penis, other phallic objects are sexual assault rather than rape.

    A woman who has the necessary parts can commit rape, but this restricts that classification to intersex and pre-op trans women. Likewise not all men can commit rape, some like intersex or trans men cannot, nor can those otherwise without a penis.

    In UK law only a person with a penis can commit rape.

  • This sounds uneven / odd, but I understand if a person with no penis sexually assaults someone in a comparable way to rape (had they had a penis) the sentencing/tariffs/consequences are the same.
