Current Canadian law already forbids covering the face during a criminal act,

"excuse me sir, would you mind removing your mask before robbing this bank"... Surely if someone is committing a crime, the mask is incidental.

It means a more severe crime and a longer possible sentence as it proves greater intent and forethought, and further attempts to avoid identification/capture.

A crap analogy would be robbing a shop by threatening the shopkeeper verbally, and robbing a shop by threating the shopkeeper with a sawn off shotgun.

Yep, makes sense I guess. So I should expect a harsher sentence if I'm wearing a gimp mask while pissing on a banker.

Probably lesser... Crime of passion, and all.
