    I live in Manchester and was riding in this morning, as I was turning right at a junction (green light for me) a middle aged business woman stepped out in front of me we crashed but no one went down. A couple of plain clothes police saw it happen and came running over, she told them she wants to file for assault and basically they talked her out of that and issued me an on the spot £80 for "using threatening and inappropriate actions in a public place under the section 5 public act" I disagreed and said what if I don't accept the fine and they said il spend the day in the cell by this time id been sat in the back of the car handcuffed for an hour already so took the fine and got on my way, the police were sound about it all but still feel like the blame shouldn't have been on me, iv basically learned from it to calm it down abit when in the city centre, oh also he asked how many breaks I have on my bike, its fixed with a front break so I said 2, the rear wheel is directly connected to the cranks so you use your legs and he seemed fine with that, felt I needed to share my experience with you.

    Shit, bad luck on the plain clothes police being around. :(

    Cyclist v middle aged business woman - you are never going to win that one. Nice one on the brake talk though.

  • Pedestrians have right of way. If you turn right (green light or not) and hit a pedestrian, it is your fault.
    £80 does seem a bit harsh though.

  • I went to court for that and got let off scot-free.
    Mike payed the fine.

    The magistrate just looked at the papers and said, "I don't know what you are doing here this morning".

    still all of this is wank. you may be hard done by, but pay fine, move on.

    If so, that suggests that pedestrians can basically ignore all traffic lights, and cross when they choose, irrespective of traffic flow. If they are hit as a result, then it's the fault of the person who hits them?

    I know that if you're turning from a main road into a side road with the dashes on, then its the peds right of way at all times, but is it the same if there are traffic signals. If so, we're wasting a lot of money on pedestrian crossing lights.

    I'm not trying to argue, just trying to understand.

    WWWWAAAAAYYYYYYY more crucial to everyone's understanding of cycling/driving/walking is that if you can avoid an accident you MUST. If you went to court on this the judge would think, you could have avoided this and you didn't. Right of way or not, you can't plough into someone. And I think any reasonable person would think thats a reasonable stance. If you see her but decide to hit her because you have the right of way then thats just mean.

    YES. at all times. most vulnerable road user should be protected by the law. Same applies to cyclists v. cars.

    IMO it's ***lucky ***that the cops were around and saw the incident. They got you off a possible accusation of assault with a vehicle. the fact that you lost it and got done for threatening behavoiur is your own fault. You did it, you got caught, pay the fine and move on.

    sorry if that's harsh, but compared to a false accusation of assault and everything that involves, you got off lightly..

    edit: ok that's a bit harsh. If you weren't threatening, then I would think about fighting it.

    It was two o'clock in the morning and I was gassed, would have had to sleep on Mikes floor anyway.
    As it was I got let out at seven with free breakfast after a nice sleep.

    In voids case he accepted the fine but in no way is that an admission of any wrongdoing as he has not been charged.

    I still don't think he should pay it. The case would be laughed out of court, if it even made it that far.

  • Pedestrians always have right of way, but that doesn't mean it is your fault or that you will be automatically charged if one jumps out in front of you and you couldn't practicably stop.

    It's my favourite. ped has right of way if turning into a juntion, if at a stop sign you have to wait for an opening. she still has right of way.
