The question was whether the driver caused a death through an act that, while lawful, was grossly negligent because he had allegedly failed to consider his duty of care to other road users. The jury concluded that Mr Aydogdu was not guilty of this offence.
But I thought Dooring was illegal? -

There was a people mover released a few years ago that had sliding doors. Here.. Pug 1007
"In the Netherlands, they teach people to open a car door with their opposite hand - so if you were in a right-hand-drive car here, you would reach over with your left hand. That means your body turns and you look over your shoulder"
Never heard of this. Great idea.

The Kaiser Darrin did this in the 1950s, and proved it could be well executed too (sorry for the big image).

This.
No need to change the law since it's already illegal to open the door, the jury somehow sympathies with the drivers despite the fact all the evidence pointed to being guilty of the offence.

- No person shall open, or cause or permit to be opened, any door of a vehicle on a road so as to injure or endanger any person.
One of the oldest laws in the book as it dates from horse and carts.

I was merely having a little fun with Ed as he stated only that it was illegal to open the door.

The penalty for that is max £1000/no points, so not really appropriate when someone is killed.
The problem is that there is no law which deals directly with someone being killed by a car which is not being driven.
Mr Aydogdu was charged with gross negligence manslaughter, but the jury didn't go for it, even though his car had dangerous modifications.
In this case, investigators at the Metropolitan Police's Road Death Investigation Unit come across roughly one incident a year that is similar to Sam Harding's death.

Wouldn't manslaughter or murder be applicable?
If someone kills someone with any other machine it's manslaughter or murder, why not in cars too?
-

He was charged with manslaughter. Murder needs intent to kill or cause GBH.

The acquittals in both cases resulted from decisions made by juries. In both cases it seems likely that the jury took the view that the driver’s failings weren’t *bad enough *to amount to the serious offences (carrying significant jail terms) which were charged.
For so long as cars are the principal way of using the roads, there is a risk that juries will have sympathy with motorists, and will be reluctant to convict a motorist of a serious offence (resulting in a prison sentence) based on what may have been a relatively common driver error.
The result is that the convictions which are obtained (and the sentences that follow) often seem trivial in cases like those of Sam Harding and Mary Bowers, and it seems that the available laws aren’t adequately enforced, so that vulnerable road users aren’t adequately protected.

Well - have just had an apology from Police into the way they investigated (ha!) my clavicle snapping dooring incident. Now that they've actually asked for the front and rear Fly 12 / 6 footage they've decided that the CPS do need to take a gander. Previously they'd decided that because the driver and passenger disagreed about who told who to do what they couldn't do anything more.
Police who dealt with the complaint have been tip top. Police who dealt with the initial incident were abject to the point of being unable to write a coherent email.
^ that is a very good idea, I think I do that, will check next time I am in a car, but will tell everyone I know about it. Genius!
