What makes it a fail?
The Sunday Herald being brave enough to cut the distribution of the paper to stop any being sold south of the border and to run the story is pretty win to me.

Giggs is the 'epic fail' in all of this, rather than taking out in injunction he could have just come clean and everyone would have forgotten about it in 3 months time. Whereas now theres this whole shit storm regarding internet privacy laws and publishing news online vs. print.

So I guess we are both correct. The newspaper isn't a fail whereas the man in quesion is.

I think parliament shirked responsibility for privacy law to judges in the hope they'd arrive at something reasonable by working on a case-by-case basis. But the judges have proved utterly unworthy of the task.
