    Four photos were listed in the ad, one of which appears to show a scratched stay.

    An offer to view the bike beforehand was extended.

    And as Dale said it was collected.

    That would be my argument as the seller.

    I think this is true, but i still don't think it was in 'very good condition'.
    Bmx or not, looking at the pictures i wouldn't advertise that bike as 'good condition', i'd say it was 'used but in ok condition'
    He isn't just describing the working order (a scratched frame wouldnt affect this) but the conditon as well, i.e appearance.

    Maybe, but some detail why would be helpful.

    Also, his returns policy says this:

    "All items sold can be returned for a refund.

    Conditions of Refund:
    -Items must be returned within 14days of the purchased date.
    -Items must be returned in the condition they were received (including any packaging).
    -The buyer is responsible for the cost of the return postage.
    -Only the money paid for the items will be refunded. Postal charges will NOT be refunded."

    He doesn't stipulate reasons for return - my listings always say "refunds only if item significantly not as described" - which logically means I can return it for any reason I like. If he doesn't respond to contact requesting a return then that's his problem.

    Isn't this purely misrepresented condition? These are by no means "minor scratches", and these weren't shown in the listing photos or mentioned in the description - hence my finding it hard to understand why I might not have a case here.

  • Not a legal term I know, but I'd describe that bike as "scratched to fuck", more than worthy of a mention in the original listing.

    I would not buy a bike that badly scratched up, unless it was very cheap.

  • The guy made contact by e-mail yesterday, saying he was happy for me to return it for a full refund. He did seem to hint that my expectations were too high, but if I'm returning it I don't mind too much what he thinks.

    He hasn't replied to my e-mail asking when I can drop it back, but it seems that the situation has improved slightly at least. Still pretty shoddy though - really slow on the uptake and not the easiest person to contact.

    I gave the guy a chance. He didn't respond so I started ebay's dispute resolution. They should give me my money back. Of course it all means I've had the frame sitting around for a month longer than I should have. There should be an IQ test before you can use ebay.
