Also AFAIK Gore is the same company (or sister/daughter company of) which owns the Gore-Tex trademark - so I doubt they want other companies in the cycling market using the fabric/brand.
It's quite likely that the Hardshell is made of a pretty identical fabric though, as the main patent on Gore-Tex has expired.
