Flashing lights were not road legal for many years. They now are if they conform to the appropriate standard. However the vast majority of LED lights are ironically enough not legal in steady mode with the exception of certain European (largely dynamo) lamps.
A lot of people say that flashing lights impair distance judgement - others argue they are more visible. My personal preference is for steady lights but ymmv.
Certainly if you are riding on dark lanes you would be well advised to get a bright road legal steady light (eg. b&m, edelux, phillips).
