I do not understand how an accident involving a car clipping a cyclist on the other side of the road can be anything but driving without due care and attention. The other convictions would surely follow or not exist at all without the first crime?
These attitudes towards cycling are the problem, no one will protect you out there or after an accident but yourself, and even then - cycling at 18mph on your side of your road you can still face a 3-tonne death cage. Its just exasperating, if not terrifying.

Is there anything stopping Toby perusing a civil case in a court where the standard is "on the balance" rather than "beyond reasonable doubt"?
Add extra damages for the trauma caused by her team dragging it through the high court?

Well, the mags verdict might help any civil claim for damages. Not sure you can sue for the trauma giving evidence in the prosecution of someone who has hurt you, and it'll have been the CPS that got this into the mags court. But IANAL. Oh, hang on, I am a lawyer, but that doesn't mean I know this stuff.

But frankly, it's difficult to see what damages he could claim since as far as I'm aware he wasn't injured and hasn't suffered psychological trauma.
And he can't claim damages on the basis that she's successfully defending the prosecution for careless driving. For many, many reasons, the fact that she won on that score being the most obvious.
