    More importantly, the blood bags that were confiscated (and through his guilt rendered prosecutable evidence) are NOT to be handed to anti doping authorities for DNA testing.

    If it was guaranteed that only cyclists were involved I'd bet they would allow testing - with the risk of footballers, tennis players and golfers involved, the bags are left untested.

    Stinks.

    As i heard it being reported the type of doping offences being alleged were not even a crime in Spain at the time the blood bags were produced by the various nameless athletes.

    The only charges they could bring against Fuentes were on medical safety grounds because he treated patients off site and not in a medical environment.

    In my opinion the Judge is right to say they should be destroyed because whether people like it or not patient confidentiality should still prevail, unless of course something like a murder has been committed in which case it should be down to the police and the courts to ask for evidence not Dick Pound and his extra judicial anti-doping organization.

    I'm not pro drugs in sport but i am very pro sovereignty of the individual and medical records are about as personal as it gets, third parties should not have the right to access such data on the pretext that someone has cheated at games.
