“Campus police were called to the room after receiving an anonymous phone call that some students were drinking alcoholic beverages on the balcony. Campus police entered the room and found eight students of mixed gender drinking from red plastic cups. Most of the students appeared to be in various stages of intoxication. No sobriety tests were given. An empty bottle of whiskey was found in the trashcan. Citations were given for curfew and alcohol violations.”
“Miss Zimmerman, how do you plead to these offenses?”
“Not guilty.”
“Why?”
“There’s no evidence that I was drinking.”
“Alcohol was found in the room and the charge is for an alcohol violation which means that you were in a room where alcohol was present.”
“No I wasn’t. An empty bottle of alcohol was found in the trashcan. That’s not alcohol.”
“Doesn’t matter. There was alcohol in that bottle at some point. Guilty as charged.”
All the "due process blah unconstitutional blah" bullshit is laughable; he's not on trial so due process doesn't apply.
