It would be more sensible for the regulations to require reflective patches on the shoes used with clipless pedals though.

Google hasn't found me any actual examples of missing pedal reflectors being assessed as contributory negligence, but the legal mechanisms seem to be there. Pedal reflectors are surprisingly effective, so it could plausibly happen that their absence would matter and be noticed.
