You are right and the bars might not be below the top of the tire, but their fingers would undoubtedly touch the wheel if it was close enough.
The point is that having the bars below the top of the wheel doesnt meen that the person doesn't know anything about bikes. He might just be ignoring UCI rules which plenty of people do anyway. Real japanese keirin riders don't atleast.
I'll give you a couple of things though. He seems awfully thirsty with all that water, and having worn the top part of the bartape suggest unreasonable riding position.
