I opened an ebay dispute on the 3rd and this is part of the email I got from them.

Here's what you have to do next:
Try to work things out with the seller. If you don't hear back by 12 Sep, 2011, you can escalate this case to Customer Support.
What you should know:
This case will automatically close on 18 Oct, 2011."
