I thought it was 2 weeks to open a dispute with paypal.
If they can, let them open a dispute with paypal or ebay, then simply state your listing about the damage and it will be obvious they are in the wrong.
In future if you are selling something damaged make sure to clearly write that you will not accept returns and the buyer is receiving the item exactly as described/pictured.
