Surely if the lock was attached to your bike and not another, then there's no excuse for them if it went to court?
If they parked their bike or a crap decoy next to yours and locked yours "by accident" then they could claim it was a mistake, but just the lock, not so much.
Would like to see a criminal damage case come against someone who chopped off a lock in those circumstances. Would hope that the claimant was instead done for attempted theft.
