    Just to clear that up... if a driver gets nicked for using a mobile phone while driving (and driving is defined as having the engine running even whilst stationary.. and using doesn't have to be talking on it....) it's 3 points non-negotiable and £60 fixed penalty, albeit it could be more if it comes to Court.

    The 3 points stay 'live' on the driving record for three years, but present on the paper licence for four years... 12 'live' points in 3 years and risk of 6 month disqual.

    It had been proposed under the last government that using a mobile should go up to 6 points, but I believe that's been dropped now.....
