Yep, the seller is most likely just being sneaky, but I'd leave it... going through the eBay resolution centre is like having your balls removed.
Once a listing is within 24 hours of the auction's end, you are legally obliged to sell to the highest bidder, no matter what your auction states. The legal consequences of not doing this are that you have to say sorry and defend your side with bullishness and vile, failure to comply with the aforementioned means you'll get kicked off of eBay for good, sometimes, maybe, possibly, probably not.
