Yes I know that. In the real world, it does matter. Buying some Heroin and buying some Cannabis are both crimes, should they both be punished equally by the law? Do you think it's a shitty defence for the Cannabis buyer to say "My drug does less damage to society as a whole than his drug, so I should receive a less harsh sentence", or is that invalid to you?

They are different crimes (different classes of drug).

And in any case, I'm not going to defend fucked up laws.
