  • Her actions had a direct influence on his actions, how can you not see that? Of course her actions are completely relevant, if she is looking to convict him for assault. Any court will most certainly take this in to account, and they did.

    Nice try. Of course her actions will be taken into account in terms of what she did before she was hit (i.e. did she hit him, did she threaten him, did she have a knife). However, they did not take into account her getting 50k after the fact (this is what I meant when I wrote "ex post facto"), which is what we are actually arguing about.
