Surely any road user has a responsibility to their own safety as well as the safety of other road users. In this case, yes, if the driver had the mirror he may have seen her, but she also had a responsibility to choose an appropriate place to cross the road and to be aware that traffic waiting in a queue may well start to move without warning.
