There isn't enough information available to judge either way. 'Lack of evidence' is one of the favourite reasons for doing nothing. It does sound suspicious--there are lawyers around who are able to get people off charges like this on technicalities. They have their price, so are available to you if you have the money. One's particularly famous, but I'm afraid I can't remember his name.
It is a well-known fact that the law in this country for dealing with situations like this is woefully inadequate and in dire need of reform, but government after government fluffs this.
Tragic, infuriating, and sad.
