It is NOT legal to sell something that you don't own without clear consent.
I don't see how this isn't selling stolen goods, and as anyone will tell you, "Two wrongs don't make a right.".
The OP selling this because of unpaid debt doesn't make it 'morally legit'... it would definitely be classed as stolen.
