johan, it needn't become a full-blown civil case if the drivers' insurance pays up damages and you're happy with that (less hassle for all involved), but your solicitor will obviously be on top of all that.
Don't hope for a prosecution for a driving offence. It may happen, but it very rarely does, unfortunately, and there'll be a large number of 'worse' cases than yours ahead in the 'queue'. However, do your best to pursue it until you get (hopefully not) the 'we will take no further action' letter by the police.
