Was the late fee in the initial terms and conditions rather than just on the invoice?
Realistically, what's your relationship line with the client and how big is the invoice? There's a pretty good chance they're of the view that the late payment invoice was a scare tactic and now they've paid the original it can be ignored.
Charging interest and a late payment fee - would I charge interest on the interest if the late payment invoice isn't paid on time but the original invoice is paid within 30 days from late payment invoice?
back of napkin example:
01 08 2023
Invoice
01 10 2023 (so 30 days after statutory period)
Invoice separately for late payment interest, plus £40 comp.
15 10 2023
Original invoice gets paid
20 11 2023
No sign of late payment invoice sum clearing - has interest been accrued on the 5 days the late payment is overdue?
Would I charge interest on the late payment invoice? I can't charge interest on the original payment by that stage as it's been paid. But I don't want to leave anything on the table.
